DWI Checkpoint 2019- Different Documents
Dear Monmouth County Prosecutor's Office,
This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:
Please send your response in PDF format.
1. Copies of the 'Officer in Charge' Report(s) for each of the DWI Checkpoints that were held during the year of 2019.
2. Copies of the list(s) of all individuals arrested and/or given traffic summons for each of the DWI Checkpoints that were held during the year of 2019.
3. Copies of the prosecutor's directives, policies, rules, and standing orders for the operation of the DWI Checkpoints that were held during the year of 2019.
4. Copies of any the prosecutor's directives, policies, rules, and standing orders for dealing with corporate media, citizen media, and citizens in relation to documenting(photographing and videotaping) the DWI Checkpoints that were held during the year of 2019.
Please include a Record Index with your response.
*A record index that identifies each record requested and the specific legal basis for a denial of access (including redactions) to each record.

I'm amending this OPRA request to include this.
5. A list of all law enforcement officers by rank, name, badge number, police department and support personnel that were involved for each of the DWI Checkpoints that were held during the year of 2019.

Attached please find records that we have that are most responsive to the below request.
The reports list individuals charged with DWI, and list non-DWI traffic summonses that were issued. The reports do not identify all individuals who were given traffic summonses. We do not have a record responsive to that request. We also do not have a record responsive to the request at #4 below.
The response to your request of 8/20 went out this morning. I am going to treat the below as a separate, new request, which we will respond to in due course.

Page 2 is not missing; it was not provided because it was not responsive to your request.
I do not maintain these reports and have not seen them. Your request was forwarded to the individual who handles DWI Task Force for this Office. He sent me the documents that he determined were responsive. Those same documents were forwarded to you.
Item #1 of your request was identified as "Officer in Charge" report(s) for each of the DWI checkpoints. Item #2 of the request was for "all individuals arrested and/or given traffic summonses" for each of the checkpoints.
The reports that you were given are not identified as "Officer in Charge" reports. We do not have records called "Officer in Charge" reports. The reports that you were given are "Monmouth County DWI Strike Force Operation/Activity Reports." You were given the Operation/Activity reports because they are the records that we have that are most responsive given the information that you have requested.
I have spoken with the individual who provided me the records in satisfaction of your OPRA request. He confirmed that page 2 was omitted because (1) you did not request "Monmouth County DWI Strike Force Operation/Activity Reports"; and, (2) page 2 did not contain any information that you requested and therefore was not responsive.
I have received the many emails of today amending the many requests of last night -- changing the request for "Officer in Charge" reports to "Monmouth County DWI Strike Force Operation/Activity" reports. If you want the "Monmouth County DWI Strike Force Operation/Activity" reports (in their entirety) for 2019 as well, you are free to submit another OPRA request for same.

***I sincerely apologize for the 'confusion; over the name of the reports. Your average citizen, including myself, doesn't know all of the official names of all the reports/documents that the MCPO uses during the course of their official business. Again, I do appreciate your efforts...!!

I sincerely apologize for the confusion over the name of the reports . Your average citizen, including myself, doesn't know all of the official names of all the reports/documents that the MCPO uses during the course of their jobs.
