Hunterdon County Public Records
Record request #22-1016 has been closed. The closure
reason supplied was:

Dear Requester,

Hunterdon County is in receipt of your Open Public Records
Act (OPRA) request received on 08/01/2022. As such, the
seven (7) business day deadline to respond to your request
is 08/10/2022. This response to your request is being
provided to you on 08/10/2022.

This response follows the numbering in your request.

Your OPRA request sought access to the following:

"(1) Date property was foreclosed upon and sent to the
County office for auction

(2) Copies of newspaper or announcements of auction sale
clearly showing date of announcement

(3) Information regarding other offers for 638 Brunswick
Pike, if any existed

(4) Total amount of back taxes owed on property

(5) Any correspondence between the West Amwell Township
committee member and County of Hunterdon Sheriff's office
regarding this property since 1/1/2018

(6) Any correspondence between Zach Rich and County of
Hunterdon Sheriff's office regarding this property since
1/1/2018"

Please note your request is not in its entirety a valid
OPRA request because it asks questions or seeks
information and fails to identify with reasonable clarity
all the specific government records sought. A party cannot
satisfy this requirement by simply requesting all of an
agency's documents. See Bent v. Stafford Police
Department, 381 N.J. Super. 30, 37 (App. Div. 2005). A
custodian is not required to conduct research or create
new records in response to an OPRA request.

(1) That notwithstanding, the Hunterdon County Sheriff has
advised as follows:

Judgment was entered on June 1, 2016. Paperwork was
received in our office on June 20, 2016. Sale was
scheduled for September 28, 2016. The attorney for the
Plaintiff cancelled the sale on September 15, 2016 after
adjournments. New paperwork was received on June 7, 2017
and sale was scheduled for July 19, 2017. After
adjournments new paperwork received on May 17, 2021. Sale
was scheduled for June 23, 2021.

(2) The County Sheriff has provided the attached records
which are responsive to your request.

(3) The County Sheriff has advised there are no responsive
records inasmuch as there were no bidders at the sale on
June 23, 2021.

(4) Please be advised this is a municipal matter. You
should contact West Amwell Township to request tax records
for this property.

(5) The County Sheriff has advised there are no responsive
records inasmuch as there is no such correspondence.

Information contained in this Open Public Records Act
(“OPRA”) response may include records that are subject to
Legislation recently enacted by Governor Phil Murphy which
protects the home addresses and telephone numbers of
judges, prosecutors, and law enforcement officers from
public disclosure (“Daniel’s Law”). Daniel’s Law amended
OPRA to exclude from the definition of a government record
the portion of any document which discloses the home
address of any active or retired judge, prosecutor or law
enforcement officer. Further, Daniel’s Law prohibits
government agencies, individuals, and businesses from
knowingly publishing on the internet, or otherwise making
available, the home address or unpublished home telephone
number of any active or retired judge or any active or
retired prosecutor.

Your Open Public Records request has been processed in
accordance with N.J.S.A. 47:1A-1, et seq. If your request
has been denied in whole or in part, the County of
Hunterdon reserves the right to raise any other grounds
for denial not raised in this response. The failure of the
County of Hunterdon to assert an exception or privilege
herein does not act as a waiver of any ground for denial
not raised herein.

The County considers your OPRA request completed and
closed.
