Disciplinary/Personnel Records for Officer M. Scanielo

Pursuant to the New Jersey Open Public Records Act (“OPRA”), N.J.S.A. 47:1A-1 et seq., and the New Jersey common-law right of access to public records, I request copies of the following records relating to Officer Michael Scanielo, who is employed by the Kenilworth Police Department.

All complaints, allegations, and/or reports of misconduct concerning the Officer, including any attachments or supporting documents.
All disciplinary records and outcomes for the Officer, including but not limited to:
any findings of substantiated/unsubstantiated misconduct;
any reprimands, suspensions, terminations, demotions, removals, or other discipline;
any resignation in lieu of discipline, last-chance agreements, or disciplinary dispositions;
any settlement agreements (if applicable) related to discipline.
Any internal affairs unit records concerning the Officer, including initiation and closing documents.
Any investigation reports, audit reports, body-worn camera review summaries (if they were used in any investigation/discipline), witness statements, and evidence logs used for discipline.
Any memorandum, emails, or correspondence directly referencing the investigation and/or discipline for the Officer, to the extent they are maintained as records.
Any use-of-force reports, if they resulted in discipline or were reviewed for discipline involving the Officer.
The Officer’s disciplinary history maintained by your office (to the extent it is maintained as a record by the department and subject to OPRA/ordered disclosure).

TIME PERIOD: January 1, 2005 TO PRESENT.

If you contend any portion is exempt, please provide the non-exempt portions and redact only what is legally exempt, identifying each withheld record and the specific OPRA exemption(s) relied upon.

Please provide the records in electronic format where feasible (PDF and/or native formats).

OPRA requires a prompt determination and access within statutory time frames. If any portion is denied or delayed, please provide a written explanation citing the specific exemption(s) and the factual basis for the denial.

Good morning,

Thank you for your response. I respectfully disagree with the suggestion that I am required to provide personal identifying information or resubmit my request solely on the Borough's particular form.

My request expressly invokes the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq., identifies the records sought with specificity, identifies the subject officer and department, and provides a defined time period.

Most importantly, current N.J.S.A. 47:1A-5(f) expressly provides that a request may be submitted by a completed adopted form, a letter, or an email containing the information required by the adopted form. The statute further expressly provides that a request submitted anonymously "shall not be considered incomplete."

The New Jersey Government Records Council likewise expressly confirms that OPRA requests may be submitted anonymously and that a requester is not required to provide personal contact information. The GRC's current guidance also recognizes that an otherwise written OPRA request does not have to be submitted on the agency's physical form when the statutory requirements are satisfied.

Accordingly, my decision not to disclose my name, home address, telephone number, or other personal identifying information is not, by itself, a lawful basis to reject or declare my OPRA request incomplete.

I also note that the GRC's current guidance regarding use of request forms states that a custodian should accept a communication that clearly constitutes a request for records and contains the information necessary to fulfill the request, even if it is not submitted on the custodian's official form. The GRC specifically recognizes that OPRA permits anonymous requests and that the requester's name and contact information are not required.

If the Borough contends that my submission is deficient for a reason other than my anonymity, please identify the specific statutory requirement that you contend is missing and explain precisely what information you contend is required. A blanket instruction to "resubmit using the proper OPRA request form" does not identify the alleged deficiency.

I am also not asking the Borough to disregard any lawful exemption. If any responsive record or portion thereof is exempt from disclosure, please process the request accordingly, redact only the portion that is legally exempt, and identify the specific statutory basis for each denial or redaction.

For clarity, I am requesting that the Borough process the request as an OPRA request rather than treating my anonymity as a defect.

I am aware that an anonymous requester may have limitations concerning the manner in which a response is received and may not be able to pursue an OPRA appeal anonymously. That does not change the statutory requirement that an anonymous request "shall not be considered incomplete."

Please proceed with the request and provide the records or a written, legally sufficient denial identifying the specific statutory exemption(s) relied upon.
