The Township of South Brunswick received your Open Public Records Act
(OPRA) request on February 20, 2020.   As such, the seven (7) business day
deadline to respond to your request is March 2, 2020.  This response to
your request is being provided to you on the sixth business day of the
custodian’s receipt of said request. 

Following is the response for your request:

1. January 2020 Police Department Arrest Reports.

·         48 Arrest reports are attached with following redactions:

o   Personal identifiers/Privacy Interest: The redactions of the personal
identifiers are denied in accordance with N.J.S.A. 47:1A-1, whereby “a
public agency has a responsibility and an obligation to safeguard from
public access a citizen’s personal information with which it has been
entrusted when disclosure thereof would violate the citizen’s reasonable
expectation of privacy.”

-          Phone Numbers, Date of Births, Social Security Numbers, FBI
Numbers, SBI Numbers, Driver License Numbers.

o   The photographs in the arrest reports are denied as they are exempt
under Executive Order No.21 exempts “… photographs, and similar criminal
investigation records that are required to be made, maintained, or kept by
any State or local governmental agency”, N.J.S.A. 47:1A-9(a) and Executive
Order No. 69 (Gov. Whitman, 1999), Maria Melton v. City of Camden, GRC
Complaint No. 2011-233.

2. Please provide copies of all of your police department’s Use of Force
Reports that were created during the month of January 2020.

·         3 Use of Force reports are attached with following redactions:

o   Juvenile names are redacted as they are exempt as outlined in N.J.S.A.
2A:4A-60.

3. Please provide copies of all motor vehicle accident reports for January
of 2020.

·         198 reports are attached.

4. Please provide copies of all traffic summons/tickets issued for January
of 2020.

There are 1048 traffic summons/tickets for the month of January, 2020.  We
have found that in order to provide this final item requested, it will
take a substantial amount of time as each summons must be opened
separately, redacted and then resaved.  We have one clerical staff in the
municipality that has access to this system as the records are maintained
by an outside agency and therefore she would have to pull and redact each
summons.  We have had 25 summons completed and attached here in order to
get an estimate of time to complete them all.  In order to complete 25
summons it took 18 minutes.  We estimate to complete the balance of 1023
summons it will take at a minimum 12 hours.  If you would like to move
forward with the 1023 additional summons there will be a special service
charge of $508.20.  Pursuant to NJSA 47:1A-5c if a request “involves an
extraordinary expenditure of time and effort to accommodate the request,
the public agency may charge, in addition to the actual cost of
duplicating the record, a special service charge..”  If you wish to move
forward kindly forward a check in the amount of $250.00 as a deposit and
the balance will be due upon completion. 

·         25 tickets we did to estimate time are attached with following
redactions.

o   Personal identifiers/Privacy Interest: The redactions of the personal
identifiers are denied in accordance with N.J.S.A. 47:1A-1, whereby “a
public agency has a responsibility and an obligation to safeguard from
public access a citizen’s personal information with which it has been
entrusted when disclosure thereof would violate the citizen’s reasonable
expectation of privacy”.

-          Date of Births, Driver License Numbers

You have a right to challenge the decision by the Township of South
Brunswick to deny access.   Information regarding an appeal process is
attached for your information.
