Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

Dear Custodian,
This is a follow-up and demand for compliance with my September 24, 2025 OPRA request seeking “all training records and applications with supporting documentation for any training, certifications, and licenses issued or denied for Detective JAMIE ROSANELLE.”
Your office’s response is overdue. OPRA requires a response “as soon as possible, but not later than seven business days” after receipt. N.J.S.A. 47:1A-5(i). The statutory deadline was October 3, 2025.

At a hearing on October 15, 2025 before Judge Kareer, Assistant Prosecutor Kevin Brotzman represented that he intended to seek denial of this request based on the misspelling of the detective’s name. A misspelling is not a lawful ground to deny or delay access. OPRA does not condition access on perfect spelling, and public agencies have an affirmative duty to make a reasonable effort to identify responsive records and assist the requestor where the intent of the request is reasonably clear.
Here, the request is plainly clear. The detective at issue is the Warren County Prosecutor’s Office Special Victims Unit interviewer in State v. Christopher Urmson. Your own discovery and filings refer to that detective as “Jaime Russoniello” and “Jamie Russoniello.” Multiple official sources use those spellings as well. The slight variation between “Jaime” and “Jamie,” and any phonetic misspelling in my subject line, does not create ambiguity about whose training records are sought. During the October 15 hearing, Mr. Brotzman made it clear he knows exactly which detective is the subject of this request and nevertheless wishes to withhold the records. An agency may not withhold records on a pretext where the custodian knows the identity of the employee whose records are being requested.

To remove any possible doubt and to facilitate your search, I hereby clarify that this request seeks the training and credential records for the SVU detective who conducted the CAC interview of the child in the Urmson matter, spelled in your materials as Jaime Russoniello and also as Jamie Russoniello. Please search and produce responsive records for both name variants.

OPRA requires access unless a specific exemption applies and requires you to state the legal basis for any denial with specificity. A spelling quibble is not an exemption. Please produce the requested records promptly. If any portion is withheld or redacted, identify the records withheld, cite the specific statutory exemption for each, and provide a Vaughn-style index adequate for review. See N.J.S.A. 47:1A-5(g), -6.

Because the statutory deadline has passed, please treat this as a final demand. If I do not receive a lawful written response and rolling production within two business days, I will pursue relief in Superior Court and seek attorney’s fees and costs as provided by OPRA.

Please confirm receipt and provide an immediate estimated date of completion. Delivery by email is preferred.
