?Dear Ms. Foster,

This email constitutes a formal and complete response to your October 29, 2020, OPRA request for deposits to the NJ Trust Fund Unit resulting from Surplus/Overage monies after tax foreclosure sales; tax surplus list; overages that have not been claimed; tax lien sale surplus funds that have not been redeemed; delinquent tax properties that went up for auction and sold with overages/surplus funds that have not been claimed; tax foreclosure surplus property sales of unclaimed funds; and tax foreclosure property sales.

Please be advised that the Union County Sheriff's Office does not hold overages or surplus; any overage on a foreclosure file being closed out (due to the buyer paying) is immediately sent to the Clerk of the Superior Court in Trenton. The UCSO does not maintain any listing of this activity, which is done on a file-by-file basis and only when there is an overage. You may wish to submit a records request to the aforementioned Court: https://njcourts.gov/courts/scco.html?la....

The UCSO occasionally schedules a tax lien through the foreclosure sales. However, they are scheduled as a regular foreclosure sale and there is no report or database search that would indicate which properties sold at any given UCSO sale resulted from tax liens. If you wish to obtain a list of foreclosure sales, please advise.

The municipalities are also able to hold their own sales due to back taxes without going through the Sheriff's Office. To that end, you may wish to submit an OPRA request to the town(s) in question (see attached contact list) for any responsive documents those agencies may have on file.

Thank you for your attention to this matter.
