CVIO-26-00784 – Records Supporting Deferral and Continued Compliance

Dear Brick Township,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

This is a request for specific, identifiable existing government records only. It does not request answers to questions, explanations, research, or the creation of a new record.

With respect to Code Violation CVIO-26-00784, Code Enforcement has now stated:

* “Deferred until 8/28/26”
* “Property owner is working toward compliance”
* Status: “Open”
* Next reinspection: 8/28/26

Please produce the following existing government records:

1. The complete SDL/code enforcement case history, activity history, status history, inspection history, and scheduling history for CVIO-26-00784 from June 30, 2026 through the date this request is processed.

2. Every SDL entry, activity entry, status note, inspection entry, calendar entry, inspection queue entry, scheduling entry, task assignment, or other electronic record reflecting the August 28, 2026 reinspection.

3. Every record reflecting, documenting, communicating, or memorializing the decision or action described by Code Enforcement as “Deferred until 8/28/26,” including any SDL entry, note, email, memorandum, internal communication, calendar entry, activity entry, or status entry.

4. Every record reflecting, documenting, communicating, or supporting Code Enforcement’s statement that the “Property owner is working toward compliance,” including any SDL entry, inspection note, telephone/contact note, email, correspondence, submission, photograph, attachment, or internal communication.

5. Every written or electronic communication, including emails, letters, attachments, notes of contact, and submissions, between the property owner and Township Code Enforcement concerning CVIO-26-00784 from June 30, 2026 through the date this request is processed.

6. Every record received, created, maintained, reviewed, or relied upon by Code Enforcement concerning removal, treatment, remediation, cutting, excavation, herbicide application, pesticide application, or other efforts undertaken to bring the property into compliance with CVIO-26-00784 from June 30, 2026 through the date this request is processed.

7. Every photograph, product label, product name, pesticide or herbicide record, EPA registration information, safety data sheet, contractor or applicator information, application record, treatment record, or other document concerning any chemical or other treatment of the bamboo that is contained in or associated with the Code Enforcement file for CVIO-26-00784.

This request specifically seeks the underlying existing records associated with the Township’s statements that enforcement was “Deferred until 8/28/26” and that the “Property owner is working toward compliance.” Those statements themselves are not being posed as questions.

Please conduct the responsive-record search using CVIO-26-00784 and the associated property/address across the records maintained by Code Enforcement, including SDL and Township email records, and produce all responsive records subject to any lawful redactions.
