Dear Brick Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.

This is a request for specific, identifiable existing government records only. It does not request answers to questions, explanations, research, or the creation of a new record.
Unless a different date range is expressly stated for a particular item below, this request seeks responsive records from June 9, 2026 through the date the Township conducts its search for responsive records.
I am not requesting duplicate copies of records previously provided in response to prior records requests concerning this matter. This does not exclude any responsive record, communication, entry, attachment, photograph, updated record, or other document that has not previously been provided.
With respect to Code Violation CVIO-26-00784, Code Enforcement has stated:
• “Deferred until 8/28/26”
• “Property owner is working toward compliance”
• Status: “Open”
• Next reinspection: 8/28/26
Please produce the following existing government records:
1. Every responsive record comprising the SDL/code enforcement case history, activity history, status history, inspection history, and scheduling history for CVIO-26-00784, including every entry, addition, change, or update from June 9, 2026 through the date of the responsive-record search.
2. Every responsive SDL entry, activity entry, status note, inspection entry, calendar entry, inspection queue entry, scheduling entry, task assignment, or other electronic record reflecting, scheduling, changing, postponing, deferring, or otherwise relating to the August 28, 2026 reinspection.
3. Every responsive record reflecting, documenting, communicating, or memorializing the decision or action described by Code Enforcement as “Deferred until 8/28/26,” including every responsive SDL entry, case note, email, memorandum, internal communication, calendar entry, activity entry, scheduling record, task record, or status entry.
4. Every responsive record reflecting, documenting, communicating, or supporting Code Enforcement’s statement that the “Property owner is working toward compliance,” including every responsive SDL entry, inspection note, field note, code officer or inspector assessment, telephone or contact note, email, correspondence, submission, photograph, attachment, case note, or internal communication.
5. Every responsive written or electronic communication, including emails, letters, attachments, submissions, and notes or records of telephone, in-person, or other contact, between William Burdge and/or Mary Burdge and Township personnel concerning CVIO-26-00784, 221 Cherry Quay Road, the bamboo condition, compliance, remediation, treatment, inspection, reinspection, extension of time, deferral, or enforcement, from June 9, 2026 through the date of the responsive-record search.
6. Every responsive record received, created, maintained, reviewed, or relied upon by Code Enforcement from June 9, 2026 through the date of the responsive-record search concerning removal, treatment, remediation, cutting, excavation, containment, herbicide application, pesticide application, or any other action undertaken or represented as having been undertaken to bring the property into compliance with CVIO-26-00784.
7. For the period April 1, 2026 through the date of the responsive-record search, every responsive photograph, receipt, proof of purchase, invoice, product label, product name, pesticide or herbicide record, EPA registration information, safety data sheet, contractor or applicator information, application record, treatment record, remediation plan, proposal, estimate, submission, or other existing document concerning any chemical, pesticide, herbicide, mechanical, or other treatment, removal, or remediation of bamboo at 221 Cherry Quay Road that was created, received, maintained, reviewed, or associated with CVIO-26-00784 or the subject property.
8. Every responsive email and attachment from June 9, 2026 through the date of the responsive-record search concerning CVIO-26-00784, 221 Cherry Quay Road, William Burdge, Mary Burdge, or the bamboo condition, compliance, enforcement, extension, deferral, inspection, reinspection, removal, remediation, treatment, pesticide/herbicide use, or anticipated completion or compliance at that property, that was sent, received, copied, forwarded, or maintained by or between any of the following individuals, offices, positions, or accounts:
• Darren Terrizzi and/or the Code Enforcement Officer assigned to CVIO-26-00784;
• Joanne Bergin, Business Administrator and/or in any supervisory capacity over Code Enforcement;
• Mayor Lisa Crate and the Office of the Mayor;
• Township Attorney Kevin Starkey and any Township-maintained communications sent to, received from, copied to, forwarded to, or involving the Township Attorney or any attorney acting on behalf of the Township concerning this matter;
• George Futterknecht and any Township or Shade Tree Commission account used by or involving him concerning this matter;
• the Code Enforcement Department, including departmental, shared, supervisory, or archived email accounts;
• the Business Administrator’s Office;
• the Mayor’s Office;
• the Zoning Office, to the extent records concerning this matter are maintained there; and
• any other Township email account to which a responsive communication concerning CVIO-26-00784 was sent, received, copied, forwarded, transferred, or referred by any of the individuals, offices, positions, or accounts identified above.
This request specifically seeks the underlying existing records associated with the Township’s statements that enforcement was “Deferred until 8/28/26” and that the “Property owner is working toward compliance.” Those statements are not being posed as questions. This request seeks the existing records in which the underlying communications, observations, submissions, actions, decisions, scheduling, or status changes were recorded or memorialized.
Please conduct the responsive-record search using CVIO-26-00784, 221 Cherry Quay Road, William Burdge, and Mary Burdge across the records maintained for this matter, including SDL/code enforcement records, the Code Enforcement case file, Township email records, the individual and departmental accounts identified above, shared and archived mailboxes where applicable, and inspection, calendar, scheduling, queue, task, and status-tracking records.
Records previously provided need not be duplicated. However, a prior production should not be treated as satisfying this request with respect to any responsive record that was not actually included in that production.
If access to any responsive record or portion of a responsive record is denied or redacted, please identify the specific legal basis for the denial or redaction and produce all nonexempt portions of the record.

In response to a different request, the Township advised that some electronic requests may not be received because of a firewall issue. Please confirm whether this request was received. If it was received, please advise when I can expect a response. If it was not received, can it be processed from this submission, or must I submit it again as a new request?

Understood, however, that withdrawal was related to a completely different request. The withdrawn request is titled "CVIO-26-00784 – Records Supporting Deferral and Continued Compliance" and the one that has not been answered yet is titled "CVIO-26-00784 – Enforcement, Compliance, Reinspection and Related Records". It was submitted on July 20, 2026. I hope this helps.
