I would like a full financial statement of the municipal bond Camden County and/or the Pollution Control Financing Authority of Camden County has to finance the trash incinerator operated by Covanta in South Camden. Please include as much detail as is available in this financial statement ('s) such as payoff date, annual payments, interest rates, bond ratings, etc.

I would also like a copy of the current lease the Pollution Control Financing Authority of Camden County has with Covanta for the incinerator property.

To Camden Clean, requester of Public Information:

 

You have requested certain information from the Pollution Control
Financing Authority of Camden County (“PCFACC”).  Your requests and our
response follows.

 

 1. I am seeking documentation of the annual host fee paid by the Covanta
Incinerator to either Camden City and/or Camden County.  I am hoping
the documentation details where any potential host fees are paid.  I
would also like statements of any other annual taxes and/or payments
in lieu of taxes paid by Covanta to either Camden City and/or Camden
County for their facility in South Camden.

 

Response:  The PCFACC is not a party to any agreements between Camden City
and/or Camden County and Covanta regarding host community fees or taxes. 
As a result, the PCFACC is not in possession of government records that
are responsive to this request.  We are not aware of the current status of
any agreement(s) of this type.

 

 2. I would like a full financial statement of the municipal bond Camden
County and/or the Pollution Control Financing Authority of Camden
County has to finance the trash incinerator operated by Covanta in
South Camden. Please include as much detail as is available in this
financial statement ('s) such as payoff date, annual payments,
interest rates, bond ratings, etc.

 

Response:  There are no outstanding bonds of the County or PCFACC
regarding the Covanta waste to energy plant in Camden County.  The
original system revenue bond issue for the construction of the facility
was paid in full in 2010.

 

 3. I would also like a copy of the current lease the Pollution Control
Financing Authority of Camden County has with Covanta for the
incinerator property.

 

Response:  The current land leasehold agreement between PCFACC and Camden
County Energy Recovery Associates, LP is contained in the Amendment to
Ground Lease and Second Amendment to Ground Lease, each of which are
attached hereto.

 

Based on the above information and the attached documents, the PCFACC has
provided all responsive government records in accordance with OPRA and the
common law right to access.  If you believe we have misinterpreted any of
your requests, please provide additional specificity as to the records you
are seeking.
