Dear OPRA requests at Clementon Borough,
This is reply to the previous request. It states in the reason you did not provide separation actually says that the exception to the policy of not releasing personal disciplinary issues is being separated on bad term and what the terms where when the current Construction clerk was fired from her previous position for Clementon Borough. Also, for what reason is their a denial for the video of her coming in and out of the municipal building the day she made the BLM Protest flyers and tore down them and reported to the Borough. Also, The police report from Ofc Mackey is incomplete and doesn’t not state the department and the reason why he was asked to assist the code enforcement officer. Not only that The original request for the notes as well as the report the Code enforcement officer stated on video he would provide as I actually have video of him writing notes and starting he would provide further details on the complaint as he stated it was a complaint generated by the Construction Clerk. Again I have this on video so I don’t know why these things are not being provided.

Yours sincerely,

Nickoles Stankowski

OPRA requests at Clementon Borough, Clementon Borough

Mr. Stankowski,
Please provide clarification on which, if any, additional records are being sought in your most recent correspondence.
Opra requires the municipality records custodian to provide records in the custody of the municipality, with certain exceptions. I have provided you with all documents responsive to your request. For those records that were denied, I have provided you with a legal basis for each denial.
In my response, I provided documentation on file reflecting the reason for her prior separation as the Deputy Clerk. There was a council vote for re-appointment at a public meeting, that was not approved by the majority (Minutes of the 3.6.18 Caucus Meeting).

In your initial request, you requested videos of the "Municipal Election Building viewing her inside and outside of the Building". Elections are held at 165 Gibbsoboro Road, in the Community Center. The Borough does not have video equipment on site at this facility. The records were not denied. They simply do not exist.
As the custodian of general records for the Borough, I assure you that I have diligently requested any responsive records from the respective departments. There were no records found in response to your request for the "Code Enforcement Report" or "complaint from Construction Clerk against Black Lives Matter". You were provided with a copy of the Police Incident Report, which documents the interaction between you, the Code Enforcement Officer and Officer Mackey.
Please feel free to contact me regarding this matter.

Dear OPRA requests at Clementon Borough,
I’m asking for the video of the Construction clerk entering and exiting and through the building with the flyers she tore down which she was witnessed entering the municipal building with. I’m requesting the Official documentation attached to her personal record and specific reasons on why she was removed from her previous position other then council meeting minutes and is the exception to the law you cited personal records being shared. I would in fact request any disciplinary records for previous and current position. Again The Code enforcement officer did make notes as I watched him make notes right in front of me as he was documenting everything on video also promising to send a completed report of the interaction . Also, I would like fully filled out police report as this report provided is not completed and doesn’t even state the interaction between what department and myself was occurring. It didn’t even state who made the request for him to assist the code enforcement officer. Also by legal standards he is required to fill out all sections of the boiler plate document and the absence of this information legally is considered falsifying documentation according to state statutes and standard state guidelines on police police reporting by the NJ state BOT and the NJ State attorneys office. I please ask that they comply or will have to report it through the proper Chanel’s with all evidence of our interactions . Also, be aware any knowing knowledge and refusal or intention to not produce these documents as well as any assisting of espionage or corruption holds you personally civilly and criminally liable and isn’t covered under limited immunity laws.

Yours sincerely,

Nickoles Stankowski

Dear Mr. Stankowski.
I am writing to follow up on your comments from the Council Meeting last evening related to unanswered Opra Requests that you submitted. After the meeting, I took the opportunity to investigate the "Opra Machine" website that you referenced, on which you reported the delinquent requests were published. It appeared that you have marked four requests "long overdue".
I do not monitor the Opra Machine website as it is not a governmental site, and was unaware that there was an available database of requests made to the municipality through that platform.
I would like to provide a detailed analysis and status of the requests listed in the database that were submitted by you to the Borough of Clementon, and marked as "Overdue" in the order they were chronologically submitted:

July 10th Request
https://opramachine.com/request/clemento... titled "Clementon Code Enforcement/Police reports on surveillance and complaint of Black Live Matter Flyers and all materials involved and all parties."
Although this request is marked "overdue", it is in fact complete. A response was provided and all documents responsive to your request. I see that you did in fact send a final email, noting your disagreement with the response, but there was not any further information to provide. The request had already been satisfied to the best of my ability.

July 17th Request
https://opramachine.com/request/clemento... titled "Clementon Police Department SOPs and policies"
As you can see on the response from the Borough, You received an automated mail delivery failure notification for this request, and I was not aware of it's existence until I discovered it last evening. I will expeditiously provide a response to this request.

July 17th Request (second request on same date)
https://opramachine.com/request/request_... titled "Request for All complaints against Clementon PD"
This request also received an automatic delivery failure, and was not received by my office on July 17, 2020. I will also process this request and provide a response as I became aware of the complaint on 12.15.20.

July 17th Request (third request on same date)
https://opramachine.com/request/wiggins_... titled "Wiggins Vs. Clementon Borough and Clementon PD"
The third of the request submitted on July 17th received the same mail delivery failure notification. There was obviously an issue with delivery to our email system on that date. This request was received by me last evening as well for the first time when I investigated the Opra Machine Website. A response will be provided.

If in the future you have concerns related to an Opra request or feel that it is overdue, please communicate that to my office immediately to allow for earlier rectification of the matter. These requests were made in July, and last evening was the first time that you communicated their existence. My office strives to ensure compliance with the Open Public Records Act, and transparency in the functions of the municipality.
Thank you and have a great day.
