I received your Open Public Records Act (OPRA) request on February 28,
2020 for "Council meeting minutes from September 2014 - December 2014."
In addition to your request dated 2/28/2020 for" Bill lists for every
council meeting in 2019 & 2020, Ordinances 2019 & 2020, resolutions for
2019 & 2019." As such, the seventh (7th) business day deadline to respond
to your request is March 10, 2020. This response to your request is being
provided to you on the seventh (7th) business day after receipt of said
request.

This request requires additional time beyond the seven (7) business days
to fulfill. The majority of your request has been fulfilled and forwarded
to you in 15 separate emails for your initial request dated 2/28/2020. I
do not have an electronic copy of council minutes for 2014, and as such
they are memorialized in a minutes book and stored in the borough safe.
This will take extra time in addition to your initial OPRA to fulfill.
You can report to borough hall at borough regular business hours and view
the minutes book. If you do not respond I shall make the necessary
arrangements to copy and forward the documents you are requesting. If
this includes a cost I shall receive a cost estimate and ask you if you
shall pay for the duplication costs. Please advise. OPRA allows
custodians to seek extensions of time pursuant to N.J.S.A. 47:1A-5.i.
Specifically, OPRA states that, "the requestor shall be advised by the
custodian when the record can be made available. If the record is not
made available by that time, access shall be deemed denied." This request
requires an initial extension of time until March 23, 2020.

If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the Borough of Wallington to deny
access.
At your option, you may either institute a proceeding in the Superior
Court of New Jersey or file a complaint with the Government Records
Council (GRC) by completing the Denial of Access Complaint Form. You may
contact the GRC by toll-free telephone at 866-850-0511, by mail at P.O.
Box 819, Trenton, NJ, 08625, by e-mail at [email address], or at their
web site at www.state.nj.us/grc. The GRC can also answer other questions
about the law.
All questions regarding complaints filed in Superior Court should be
directed to the Court Clerk in your County.
