The Borough of Lindenwold received your Open Public Records Act (OPRA)
request on February 28, 2019. The official Records Custodian received
your OPRA request on February 28, 2019. As such, the seven (7) business
day deadline to respond to your request is March 11, 2019. This response
to your request is being provided to you on the 3rd business day after the
custodian’s receipt of said request.
Your OPRA request sought access to the following:
Records requested: for the period 2015-2019 YTD: payroll, timesheets
and/or salary records/ordinances for all Library personnel; timesheets of
any and all Public Works employees who spend time/perform work at the
Library including grounds keeping hours (mowing, painting, power washing,
installing blinds, moving boxes, cleaning gutters, etc), cost of any and
all interior upgrades and/or improvements, cost of health insurance for
any Library employees, cost for liability and accident insurance on the
building and grounds, cost of any and all new materials including but not
limited to books, computers, furniture, DVDs, subscriptions, office
supplies, software; all utility bills including water, sewer, internet,
telephone, electricity, gas, etc.; holiday/vacation time payouts, any and
all expenditures on the grounds including but not limited to any sheds or
exterior structures, parking signs, sprinkler systems, video surveillance;
total numbers of hours open annually, Library Advisory Board Meeting
Minutes, any and all settlements, copy of an ALA accredited MLIS (or
equivalent), undergraduate degrees and/or valid NJ Librarian
certifications for any appropriate personnel.
Your request requires additional time beyond the seven (7) business days
to fulfill because of the amount of research and documents involved and
the age of the documents that are stored in an off-site facility.
Specifically, OPRA states that, “the requestor shall be advised by the
custodian when the record can be made available. If the record is not made
available by that time, access shall be deemed denied.”
Your request requires an extension of 25 business days until April 5,
2019.
If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the Borough of Lindenwold to deny
access. At your option, you may either institute a proceeding in the
Superior Court of New Jersey or file a complaint with the Government
Records Council (GRC) by completing the Denial of Access Complaint Form.
You may contact the GRC by toll-free telephone at 866-850-0511, by mail at
P.O. Box 819, Trenton, NJ, 08625, by e-mail at [email address], or at
their web site at www.state.nj.us/grc. The GRC can also answer other
questions about the law. All questions regarding complaints filed in
Superior Court should be directed to the Court Clerk in your County.
Sincerely,
