Corey Micciolo Treadmill Video Recovery
Dear Ocean County Prosecutor's Office,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
I am respectfully requesting a copy of Spillman case number 20BN16931 and Barnegat Police report 21-018790 and any communications, however memorialized, between the Barnegat Police and the NJ Division of Child Protection and Permanency and the Ocean County Prosecutor's Office, if any, during the initial response by the Barnegat Police on March 26, 2021, March 28, 2021 and any information on the discovery and recovery of video coverage of the treadmill in the gym at the Atlantic Heights commencing at approximately 1617 on March 20, 2021 showing Christopher Gregor and CM on the treadmill.
Barnegat Police have advised they are not in possession of the records cited above.
I am respectfully requesting the Computer Forensic (CF) report detailing the recovery and preservation of surveillance video from the Atlantic Heights apartment complex on April 3, 2021 or any earlier recovery/response to the Atlantic Heights apartments and viewing and/or recovery of video associated with your case 21-006231, 21001881 and 22000753.

Dear OCPO_OPRA,
“I permissibly vague?” I cited specific case numbers, dates and times to the minute. The CF (Computer Forensic) report number is cross referenced with one or more of the cited case numbers in InfoShare. Kindly review your response and provide the CF number to include the legal authority, detective/examiners who responded, evidence recovered (The internal hard drive of the DVR acquired from Atlantic Heights) and findings to include the date and time the OCPO first became aware of the Micciolo Treadmill Video. The Barnegat Police and Ocean County Sheriff have referred me to the Ocean County Prosecutor’s Office and have insisted you have the reports. Thank you

Dear OCPO_OPRA,
My respectful request for an internal review was submitted over 5 months ago. Kindly review and respond regarding this case in our county regarding the death of an 8 year-old child. The NJ Office of Child Protection and Permanency published their annual Federally mandated death reports for children in 2021 and wrote:
“ On 03/26/2021, a concern was received that the father utilized inappropriate discipline to punish C.M.
The father had placed C.M. on a treadmill on a very fast setting which caused him to fall, and he
sustained injuries to his forehead, chest, hip, eye, arms and legs. There was also a concern that C.M.
was slapped in the face. The Ocean County Prosecutor’s Office was notified and interviewed C.M.
who denied being physically abused by his father. Both the father and C.M. reported that the injuries
occurred by C.M. falling off the treadmill and while playing football.….”

Kindly review your reports and records and release the information regarding the response by the OCPO on March 16, 2021 or non-response. If the OCPO did not respond and the report is false kindly forward the information to the Attorney General. Falsifying reports to coverup wrong doing is a crime.
