Please be advised, we have been informed by the Pennsauken Police
Department that there are records that are involved in an open criminal
case and cannot be released via OPRA. However, the Police dept. has
requested we reach out to you and ask if you are an attorney looking for
discovery. If so, the request will have to be handled differently.
Please respond as soon as possible so that the records can be provided to
you in a timely manner.

Dear OPRA,
No, I was actually threatened by Mr Verner myself online where he threatened to shoot me in my "gay face" and called me a "faggot" and claimed he was a cop. I have not filed a criminal complaint yet, but now that I see he has this and other harassment charges, I am considering it much more.

Please be advised, we are requesting an extension of time until September
19 to complete your request.
Following up from our previous correspondence, while there are records the
are currently involved in an open investigation and cannot be released, we
have reached out to the police about whether there are any releasable
records or if everything is involved with the open investigation. We have
not received a response from the Police at this time but hope to hear from
them soon.

Be advised that social security numbers, phone numbers, & names/addresses
of minor individuals have been redacted due to privacy concerns. In Merino
v. Ho-Ho-Kus, GRC Complaint 2003-121 (Feb. 18, 2004), the Council
addressed the citizen’s reasonable expectation of privacy pursuant
to N.J.S.A. 47:1A-1 and found that the New Jersey Supreme Court, Appellate
Division held that the GRC must enforce OPRA's declaration,
in N.J.S.A. 47:1A-1, that "a public agency has a responsibility and an
obligation to safeguard from public access a citizen's personal
information with which it has been entrusted when disclosure thereof would
violate the citizen's reasonable expectation of privacy." Serrano v.
South Brunswick Twp., 358 N.J. Super. 352, 368-69 (App. Div. 2003). See
also National Archives and Records Administration v. Favish, 541 U.S. 157,
124 S.Ct. 1570 (U.S. March 30, 2004) (personal privacy interests are
protected under FOIA). Redactions are also being made pursuant to
Executive Order No. 26 (4) (McGreevey 2002)-“Information related to
medical, psychiatric or psychological history, diagnosis, treatment or
evaluation.
There are 3 reports that we are not able to release as they are domestic
violence records that are exempt from disclosure under N.J.S.A. 2C:25-33
of the Prevention of Domestic Violence Act of 1991 (“DVA”).
The Pennsauken Police Department has also informed us that there are
records that cannot be released as they are currently involved in an open
criminal investigation. N.J.S.A. 47:1A-3.a
Police have also made redactions to addresses & Car license plates per
police procedure.
