Dear Middletown School District,
This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:
A copy or screenshots of all text messages, incoming and outgoing, and emails, incoming and outgoing sent or received by Board member Jacqueline Tobacco on the cell phone she had in her possession while sitting at the dais during the Middletown Board of Education meeting on June 20, 2023. This should include include the email log and text message log indicating who the text messages and emails were sent to and received from.
Since this conduct happened while Board member Tobacco was participating in the meeting, it is a public record subject to OPRA.
If verification is requested that Board Member Tobacco was using her cell phone during the meeting, we can provide photos and video as proof.

You did not specify a topic for the correspondence referenced in your OPRA
request dated August 11, 2023. In response to your OPRA request, please
be advised that no emails were sent or received in Mrs. Tobacco's district
email account during the June 20, 2023 meeting. Additionally, text
messages that were sent or received by Mrs. Tobacco during the June 20
meeting were personal in nature and did not relate to any Board business.
Therefore, they would not be responsive to any request.
