I am presuming that the way you're conducting the search is by ELS. The list of emails produced by the search is the "email log," i.e. a listing of messages: date sent, sender, recipient. If it's not an ELS and you're logging into the email accounts, the emails listed under "sent" between the dates requested suffices as an "email log."

I am writing to request an internal review of Westwood Regional School District's handling of my OPRA request 'Copies of email logs for the Board President and Head of Human Resources'.

I made an OPRA request to the District on October 19th, 2023 seeking email logs for the Board president, the Head of Human resources, and the Superintendent between specified dates.

Mr. Rosado responded on October 25th stating that the search returned 38,000 emails. He made no mention at that time of not having "email logs." I responded on the 25th asking Mr. Rosado to restrict the dates of the search parameters and to only search for emails sent by the Board president and the Head of Human Resources, as it is not possible that two people produced an overly excessive number of sent emails within a 2-month period. I did not request new information.

As Rosado did not respond, I again reached out on November 9th. He still did not respond, in violation of the Open Records Act. On November 16th, I attempted once more to clarify my request for Mr. Rosado.

Mr. Rosado, finally, replied on November 17th and stated that he would run the search again, but did not have "email logs." I responded to him, clarifying that "email logs" are the search results (header information, dates, etc.) either from whatever ELS he is using or simply from the sent tab within the email accounts. Mr. Rosado cannot possibly have individually reviewed 38,000 emails. Hence, he has an accessible list of the emails available.

It is now November 29th and Mr. Rosado has not responded, once again in violation of the law. It would appear Mr. Rosado is purposefully attempting to obscure publicly-owned documents or is incapable or unwilling to perform his duties in accordance with the law. My OPRA request is legitimate under Paff vs. Galloway. There is no substantive difference between copying emails and copying "email logs/sent records." They are preexisting and do not require the creation of a new document. Supplying the requested information in a PDF should have taken no more than 20 minutes, even with review (as logs/headers do not contain sensitive information) and other local governmental organizations are complying or have complied with similar requests.

This request is related to legal matters and is time sensitive. If my request is not fulfilled in a reasonable amount of time after this internal review request, I will report the District and Mr. Rosado to the Government Records Council.
