Dear Englishtown Borough,
"OPRA requires that custodians must ordinarily grant immediate access to budgets, bills, vouchers, CONTRACTS (including collective negotiations agreements and individual employment contracts), and public employee salary and overtime information......In such instances, the custodian must provide access as immediately as possible. Agencies should act reasonably, however, using their best efforts to comply with this requirement. If a custodian cannot provide immediate access to records for a legitimate reason, the custodian must reduce such reason to writing and request an extension of time to comply with the immediate statutory requirement."
A response to this request is overdue. Please provide the documents requested, which were the contracts approved between the Police Chief Peter Cooke and the borough at the December 28, 2022 council meeting.

The Borough of Englishtown has been without a Clerk. I was recently appointed Interim Clerk (working after hours after my full time job) and am trying to catch up on the mess left so I apologize for the delay.
You say the response is long overdue... I am unfortunately unable to locate your original request. Can you please resend it or let me know the date sent.

The original request was sent on January 28, 2023, a month after approval. It is not understood how a contract listed on the agenda and approved by the Mayor and Council at a council meeting is not yet "received". Please advise as to the expected response date.

Revisions were needed in the contract so it is not yet signed. The Police Commission will be meeting soon to discuss. I will keep you posted as to the expected time frame.
