Good Afternoon Mr. Kratovil:

Please allow this email to acknowledge receipt of your request for “all
consumer complaints received by the county in 2022.”

The County has an estimated 400 such complaints that would need to be
compiled and scanned.  Further, these complaints would need to be reviewed
to redact each complainant’s confidential personal information, and other
information that would be exempt under OPRA.

This request is estimated to take an extraordinary amount of time to
fulfill due to the volume of documents that would need to be compiled and
would require legal review prior to release. OPRA allows public agencies
to impose special service charges whenever the nature, format, manner of
collation, or volume of a government record embodied in the form of
printed matter to be inspected, examined, or copied pursuant to this
section is such that the record cannot be reproduced by ordinary document
copying equipment in ordinary business size or when fulfilling a request
requires an extraordinary expenditure of time and effort. See N.J.S.A.
47:1A-5(c).  Special service charges must be based upon the actual direct
cost of providing the copy or copies.  Due to the nature of your request,
an extraordinary expenditure of time is estimated in order to fulfill your
request. 

Below represents a breakdown of the estimated time and materials to be
expended:

Total hours estimated to compile and scan complaints:        70
Employee hourly rate:        $37.16

 

Total hours estimated to review complaints:  13.5

Employee hourly rate: 75.05

The total estimated amount due to fulfill this request is $ 3,614.38.
Please advise if you agree to payment of this special service charge. Upon
receipt of payment, the County will begin to process your request. Please
have the payment mailed to my attention made payable to “Treasurer,
Middlesex County” and please reference OPRA # W017801-061223 on the
payment.  If less time is required to fulfill this request, the difference
will be returned to you. If no response is received within seven (7) days,
the County will consider this request withdrawn and will close the
request.  Or, if you wish to revise your request to limit the scope of
records that will need to be provided, please advise accordingly.

Dear Mike,
Thanks for your response. The cost estimate you are providing is far beyond my price range. Can you kindly clarify: Are any of the complaints digitized? Or are they all stored on paper? If there is a database or spreadsheet of the complaints, I would like to request a copy of it pursuant to the OPRA and common law right of access. Let's try to find a way to resolve this request without requiring anyone spend an extraordinary amount of time on it.

In response to your most recent and supplemental request, attached please
find a spreadsheet listing all consumer complaints for 2022.  Pursuant to
N.J.S.A. 47:1A-3, I have removed reference to complaints for which there
is an ongoing investigation, or that were referred to another entity for
further investigation. By way of response to your other inquiries the
complaints are stored digitally, but the documentation would still need to
be compiled and reviewed to make it responsive to your request. Please let
me know if you have any additional questions, or would like to discuss
this matter further.
