Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per N.J.S.A. 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records Requested:

1. Any internal policies, directives, standing orders, or written guidelines of the Spring Lake Police Department addressing conflicts of interest arising from a department member's familial relationship with a member of the Spring Lake Board of Education, including but not limited to any recusal requirements or protocols applicable to Captain Timothy Giblin regarding matters involving the Spring Lake School District.
2. Duty rosters, assignment logs, dispatch records, and CAD records for Captain Timothy Giblin for May 10, 2024, including any records reflecting whether Captain Giblin was on duty, off duty, or on any authorized assignment at H.W. Mountz School on that date.
3. Any records reflecting the assignment, authorization, or deployment of Captain Timothy Giblin to H.W. Mountz School on May 10, 2024, including but not limited to dispatch records, activity logs, incident reports, or written authorizations from a superior officer.
4. Any ethics disclosures, conflict of interest disclosures, or recusal memoranda filed by or on behalf of Captain Timothy Giblin with the Spring Lake Police Department or the Borough of Spring Lake regarding his familial relationship with Noelle Giblin, President of the Spring Lake Board of Education.
5. Any complaints, internal affairs referrals, or inquiries received by the Spring Lake Police Department concerning Captain Timothy Giblin's involvement with or presence at Spring Lake School District properties or events in connection with his familial relationship with Noelle Giblin, President of the Spring Lake Board of Education.

1. The Duty Roster Must Be Produced
Your response to Request No. 2 states that the "duty roster has Captain Giblin on duty on 5/10/2024." That response confirms that a duty roster exists and is responsive to the request. However, disclosing the contents of a government record is not a substitute for producing the record itself. Under N.J.S.A. 47:1A-5(g), access to a government record means access to the record — not a custodian's characterization of what it says.
Please produce the actual duty roster for May 9, 2024 and May 10, 2024 within the time required by law. The existence of this record having been confirmed in your response, there is no basis for continued withholding. If any portion is claimed exempt, please identify the specific statutory basis for each redaction and provide a privilege log accordingly.
2. Clarification Required on CAD and Call-for-Service Records
Request No. 1 sought all records, logs, duty rosters, dispatch logs, call-for-service records, or computer-aided dispatch (CAD) records reflecting the assignment, deployment, or presence of any Spring Lake Police Department officer or personnel at H.W. Mountz School, 411 Tuttle Avenue, Spring Lake, New Jersey 07762, on May 9, 2024 and May 10, 2024.
Your response to Request No. 1 states "No Policy." That response does not track with what was requested. No policy was sought. The request sought operational records — specifically CAD logs and call-for-service records.
