Complaint with Complainant Information for 2024 - 2025 Code Enforcement Complaints re: 1 Ellis Court

Response to this request is long overdue. By law, under all circumstances, Monmouth Beach Borough should have responded by now (details). You can complain by requesting an internal review.

Dear Monmouth Beach Borough,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Pursuant to the New Jersey Open Public Records Act (OPRA), I request copies of all records related to code enforcement complaints, inspection reports, and violation notices for the property located at:

1 Ellis Court, Monmouth Beach, NJ 07750

Please include the following information for each complaint and subsequent action:
• Date and nature of the complaint
• Any associated inspection reports, correspondence, or notices of violation
• The name of the complainant, unless the complainant explicitly requested to remain anonymous at the time of filing of each complaint.

If the complainant’s identity is withheld, I request a copy of any portion of the record that confirms the request for anonymity, redacted as appropriate to preserve other private information.

As you are aware, under OPRA, a complainant’s name is subject to disclosure unless an explicit request for anonymity was made and documented. Request for anonymity on an individual complaint does not cover subsequent and previous complaints on which an explicit request for anonymity was not made.

Please respond within the seven (7) business days allowed under OPRA. If any fees apply, I request that you notify me in advance.

Dear Joyce Escalante,

Thank you for the reply. The Code Enforcement Official Louis Tocci called me this month and said that he received a complaint about the fig bushes on my property at 1 Ellis Court. The log or documentation of that complaint including the complaintant information was not included in your response.

Are you saying that there was no complaint made and Louis Tocci lied to me or that he is creating complaints himself as a reason to access my property?

Also, in the response that I did receive it mentioned at Anthony Vellane had received complaints about plants on my property. The log of those complaints with the complaintant information was not included either.

As I am sure you know, the officials involved are required by statute to maintain a log of such information so the information should exist and should be provided in response to the request.

Thank you.

1. Please provide all emails, phone records, text messages, physical documents, and other communications between Anthony Vellane and the Code Enforcement Officer regarding 1 Ellis Court.

2. Please provide a copy of the complaint that the Code Enforcement Officer received in 2025 which he described to me in a telephone message on July 1, 2025 at 9:14 AM where within the message he stated "....so I got a complaint I got to pass it on to you...."
