OPRA allows custodians to seek extensions of time pursuant to N.J.S.A. 47:1A-5.i. Specifically, OPRA states that, “the requestor shall be advised by the custodian when the record can be made available. If the record is not made available by that time, access shall be deemed denied.”

I am writing to request an internal review of Montvale Borough's handling of my OPRA request 'Complaint: S 2022 45, defendant Julie A Allen, 2C:20-11B(1) - SHOPLIFTING'. addendum: aka Julie Maxwell Allen
On September 20 the custodian acknowledged that the requested footage "has been
retained, however is exempt as to the security exception in OPRA."
On September 26, the requestor, without agreeing to that assertion, requested the audio alone from the footage since it " in no way falls under the security exception in OPRA." Further, it is trivial to supply only the audio portion of video footage.
