Dear Neptune Township,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

- All emails, text messages, and communications between any and all Mayor, Council members, business administrator, and Sheriff Shaun Golden, Undersheriff Robert Dawson, Timothy Sidley, and Robert McLaughlin containing, EMS, Emergency Medical Services, Medstar, Monmouth County EMS, Medstar Program, Primary EMS coverage, Mutual aid agreement, Paid EMS services.

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Good morning,
You have decided not to use the approved form which is ok but you have also decided to make your request anonymously which is also ok but the consequences of that choice is you don't have the right to object or challenge the response you receive from the township.

Your request is overly broad and fails to comply with the law and case law when it comes to requesting communications. Therefore it is not a proper request and without clarification it will be denied.
Under the new OPRA law , specifically NJSA 47:1-5 (g) it states "A custodian shall not be required to complete a request, including for, but not limited to, mail, email, text messages, correspondence, or social media postings and messages, if the request does not identify a specific job title or accounts to be searched, a specific subject matter, and is not confined to a reasonable time period,"

You must define the specific individuals and titles of the email accounts to be search, specific subject found in the subject line of the email and a date range within which to search.
