Collins 2024 Citizens Police Academy Emails
Dear Livingston Township,
This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:
1. Any e-mails sent or received by Lieutenant Nicholas Collins ([email address]) relating to the 2024 Citizens Police Academy.
Yours faithfully,
Jimmy Walnuts
The Township of Livingston Clerk's Department is in receipt of your OPRA request. Pursuant to NJSA 47:1A-5(i), you shall receive a response in no more than seven (7) business days, with day one starting the day after the request has been received. (Holidays and Townhall closings do not count as business days).
Dear Jimmy Walnuts,
Your request is not a valid OPRA Request. In Elcavage v. Township of West
Milford (Passaic), GRC Complaint Nos. 2009-07 and 2009-08 (March 2010),
the Council examined what constitutes a valid OPRA request for e-mails.
The Council determined that: “In accord with MAG, supra, in order to
specifically identify an e-mail, OPRA requests must contain (1) the
content and/or subject of the e-mail, (2) the specific date or range of
dates during which the e-mail or e-mails were transmitted, and (3) a valid
e-mail request must identify the sender and/or recipient thereof.”
(Emphasis in original). Id. Please clarify your request to identify the
specific date or range of dates the emails were transmitted regarding your
requests for public records made under OPRA and the common law right of
access for:
1. Any e-mails sent or received by Lieutenant Nicholas Collins
([1][email address]) relating to the 2024 Citizens Police
Academy.
If we do not receive clarification within 7 business days, August 6,
2024, your request will be considered to be denied and closed out.
Sincerely,
Township Clerk's Office
