Dear Requestor,
A preliminary search using the parameters you identified in your request
with the search term “Collingswood” yielded over 280 emails. In order to
fulfill your request, the OPRA custodian would be required to review each
of these emails to determine if they were responsive, then conduct a
review for any privileged material that needed to be redacted or withheld,
and finally conduct a review for any other redactions appropriate under
the law, such as redactions of personally identifiable information.
Such a review would be unduly burdensome and substantially disruptive to
the DOE’s operations. Accordingly, we request that you modify the scope
of your request. Otherwise, your request will be denied pursuant to
N.J.S.A. 47:1A-5(g), which provides, in pertinent part, “If a request for
access to a government record would substantially disrupt agency
operations, the custodian may deny access to the record after attempting
to reach a reasonable solution with the requestor that accommodates the

Thank you for your response.
I am attempting in good faith to reach the reasonable accommodation contemplated by N.J.S.A. 47:1A-5(g). However, I am having difficulty understanding what scope the Department considers manageable.
My original request was narrowed substantially following the Department's prior response indicating that approximately 280 emails were potentially responsive. After narrowing the request to specific individuals, subject matter, and search terms relating to Garfield School, the Department now indicates that the revised request yields more than 5,030 emails.
This result is difficult to reconcile with the Department's earlier estimate. It is not readily apparent how a request that was significantly narrowed by custodian, subject matter, and search terms would produce a result set that is nearly twenty times larger than the prior search. Accordingly, I would appreciate additional information regarding the search methodology used so that I can better understand the basis for the Department's burden claim and make an informed effort to further refine the request.
Specifically, please provide the following information:
1. Which search terms generated the 5,030 results?
2. Were the search terms applied using an AND or OR operator?
3. Approximately how many results are associated with each individual search term?
4. Did the search include only emails involving the named custodians identified in my request?
5. What date range was used in the Department's search?
6. Is there a narrower set of search terms, custodians, or date ranges that the Department would consider reasonably manageable?
I remain willing to work cooperatively to narrow the request. However, without additional information regarding the methodology used to generate the 5,030-email figure, it is difficult to determine what further modifications would meaningfully reduce the scope of the request.
If we are unable to reach a reasonable accommodation, I will consider pursuing my rights through the Government Records Council or Superior Court. My preference, however, is to resolve this matter cooperatively and without the need for further proceedings.
