Code Violation List Request
Dear Egg Harbor Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL use the requested government records for a commercial purpose (Real Estate).
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
Code Violation List Request for 06/11/2026 to 07/12/2026. I kindly request a list of all UNRESOLVED or OPEN code violations (please do not include closed violations) for all properties in the city during this time period, specifically related to property maintenance, structural issues, and weeds. Please include descriptions of the violations, property addresses, and violation dates. I also prefer for the document to be sent here in OPRA not in my email (sometimes it does not appear in my inbox). Thank you so much!

This email confirms receipt of your request.
Please be advised that the Township does not maintain a single, consolidated list of all “code violations.” Different Township offices receive and maintain different types of complaints and violations.
The Clerk’s Office may receive records involving various provisions of the Township Code, including, for example, noise, animals running at large, mercantile matters, and other subjects that may have no connection to property maintenance, or structural conditions. The Clerk’s Office also does not maintain a system that designates these records as “open,” “closed,” or “unresolved,” nor does it necessarily receive information concerning the ultimate disposition of a matter referred to another department.
The Zoning Office, Construction Office and Police Department separately maintain their own records. The Township does not maintain a centralized record combining information from those offices with records maintained by the Clerk’s Office.
OPRA provides access to identifiable government records maintained by the Township. It does not require the Township to research and evaluate records from multiple departments, determine whether individual matters fall within the requester’s selected categories, ascertain their current status, or create a new consolidated list containing the requested descriptions, addresses, dates, and status information.
Therefore, clarification is required. Please identify:
The specific Township office or offices whose records you are requesting;
The specific type of existing record sought, such as notices of violation, complaints, summonses, inspection reports, or an existing departmental report or log;
The particular Township Code provisions or categories of violations to be included; and
Whether the date range refers to records created or issued between June 11, 2026 and July 12, 2026, or to violations that were allegedly open during that period regardless of when they originated.
Responsive records, if any, will be provided as they are maintained by the applicable department. The Township is not required to create a customized list or determine and compile information that is not reflected in an existing government record.
Your request will remain pending clarification. Once clarification is received, the Township will review the clarified request and respond accordingly.
