Code Violation List Request
Dear Neptune Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL use the requested government records for a commercial purpose (Real Estate).
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
Code Violation List Request for 03/04/2025 to 04/04/2025. I kindly request a list of all UNRESOLVED or OPEN code violations (please do not include closed violations) for all properties in the city during this time period, specifically related to property maintenance, structural issues, and weeds. Please include descriptions of the violations, property addresses, and violation dates. I also prefer for the document to be sent here in OPRA not in my email (sometimes it does not appear in my inbox). Thank you so much!

Good morning, due to staff shortages at this time we will need an extension to fulfill your request. We will provide the requested records on or before May 9, 2024.

You have not used the approved OPRA request form, which is ok, but you have also failed to provide all of the information requested on that form which is required by law.
Specifically - NJSA 47:1A-5(f) reads in part
"The form shall provide space for the name, address, email address and telephone number of the requestor and a brief description of the government record sought. A request shall be submitted by a requestor in the form adopted by the custodian and the custodian may deny a request that is incomplete, except that a requestor indicating the request is being submitted anonymously shall not be grounds for denial. A completed form adopted by the custodian, a letter, or an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request....
If a letter or an email from a requestor does not include all of the information required on the adopted form, the custodian may deny the record request. A request may be submitted anonymously provided, however, that anonymous requestors shall not be permitted to institute proceedings pursuant to section 7 of P.L.2001, c.404 (C.47:1A-6). A request that is submitted anonymously shall not be considered incomplete."
Therefore, please provide you full name, address and telephone or we will consider this request anonymous and as such you will not be able to submit any objection or complaint to either the Government Records Council nor the Superior Courts of NJ regarding our response.
