Code Enforcement, Zoning, Land Use, Fire Ordinance Violation email communications
Dear Brick Township Bureau of Fire Safety,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

Dear Brick Township Bureau of Fire Safety,
I am writing to follow up on my two Open Public Records Act (OPRA) request submitted on December 1, 2025, seeking access to records related to communications and actions of the Brick Township Fire Bureau, including but not limited to email correspondence between Chief Kevin Batzel, Fire Marshal Robert Kurilla, and other relevant parties.
As of today, more than seven (7) business days have passed since the date of my requests, and I have not received:
The records I requested,
A written denial with a lawful basis, or
A notice of extension as required by N.J.S.A. 47:1A-5(i).
I respectfully request that you:
Confirm receipt of this follow-up,
provide an immediate status update, and
Either produce the requested documents or identify a lawful reason for denial no later than three (3) business days from now.

This letter is in response to your Open Public Records Act (“OPRA”)
request seeking:
“Records related to communications and actions of the Brick Township Fire
Bureau,
including but not limited to email correspondence between Chief Kevin
Batzel, Fire

After a review of your request, access to the records you seek is denied
for the following
reasons:
The request is overly broad and does not identify specific records.
OPRA requires that a request identify records with reasonable specificity
and does not
oblige a custodian to conduct general research or compile records that are
not
specifically described. Broad requests for “all communications,” “all
emails,” or “records
related to” an agency, individual, or topic have been held invalid.

534 (App. Div. 2005) (OPRA does not permit open-ended searches for
records).

To the extent any potentially responsive communications may exist, they
may contain
exempt information under OPRA, including but not limited to:
Personnel and disciplinary records, which are exempt under N.J.S.A.
47:1A-10.
Advisory, consultative, or deliberative material, exempt under N.J.S.A.
47:1A-1.1.
Information regarding investigations or security measures, exempt under
N.J.S.A.
47:1A-3(a).
Because your request does not specify dates, subjects, or particular
documents, the
custodian cannot reasonably separate exempt from non-exempt material.
The request requires research and the creation of new records, which OPRA
does not
require a custodian to perform.
See N.J.S.A. 47:1A-1 (“A custodian shall not be required to create a new
record.”)
For these reasons, the requested records cannot be provided as submitted.
