Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

Please accept this as Rowan’s response to your OPRA request (below/attached) wherein you sought the following for RFP 26-11:

1. TN Ward Company's rating score breakdown and evaluation comments

2. CMs that were shortlisted for interviews with their rating score breakdown information and evaluation comments

3. Copy of the proposal submitted by the selected CM - LF Driscoll

Attached please find the score sheet for this RFP. The Score Sheet contains the following redactions:

1. The evaluation scores of each of the Committee Members. Under OPRA, consultative or deliberative material is exempt from production. N.J.S.A. 47:1A-1.1. The deliberative process exempts “documents that reflect advisory opinions, recommendations, and deliberations comprising part of a process by which [its] decisions and policies are formulated." In re Liquidation of Integrity Ins. Co., 165 N.J. 75, 83 (2000).
2. The names of Committee Members are exempt from publication under OPRA. IMO Application of Medicinal Marijuana ATC for Pangaea, et al. (Docket No. A-2204-18T4, et al, Nov. 25, 2020).

Rowan is prepared to produce the submission from LF Driscoll with the following redactions pursuant N.J.S.A. 47:1A et seq:
1. Signatures (N.J.S.A. 47:1A-1 and Burnett v. Cnty. of Bergen, 198 N.J. 408 (2009))
2. Tax Identification Numbers (N.J.S.A. 47:1A-1 and Burnett v. Cnty. of Bergen, 198 N.J. 408 (2009))
3. Personal Information including individuals’ home addresses (N.J.S.A. 47:1A-1 and Burnett v. Cnty. of Bergen, 198 N.J. 408 (2009)):

Due to the large nature of the submission, it cannot be shared through email. In cases like these, Rowan uses either Google Drive or FileLocker. Please advise if you are able to access documents using either of these portals. If not, please provide another way you would like the files sent to you.

You have the right to challenge the redactions made by Rowan University. Your request for the documents under common law is denied. The common law right to access public records depends on three requirements: (I) the records must be common law public documents; (2) the person seeking access must establish an interest in the subject matter of the material; and (3) the citizen's right to access must be balanced against the State's interest in preventing disclosure. Richard Rivera v. Union County Prosecutor's Office, 250 N.J. 124, 143-44 (2022); South Jersey Publishing Co. v. New Jersey Expressway Auth., 124 N.J. 478,487 (1991); Loigman v. Kimmelman, 102 N.J. 98 (1986); Nero v. Hyland, 76 NJ. 213, 222 (1978). In this case, the request fails to identify any interest that outweighs the privacy interests identified above.

Other than providing the submission, this is a full response to your OPRA request and Rowan will close this file unless you advise otherwise.
