Clementon Police Department Open Records Request
Dear Clementon Borough,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
Incident reports including officer narrative that have been coded as a fight /dispute from 11/08/2024 to 11/22/2024.
My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.
Yours faithfully,

Ciaran,
Good morning. Please read the following information regarding your

After a search of the records management system for incident reports
coded as "fight", there were (0) records located in the requested
timeframe. Regarding a search for incident reports coded as "dispute",
there were (5) records located within the requested timeframe.
Incident report pertaining to case # 2024-10291 has been attached
responsive to the request.
The release of the remaining (4) incident reports and narratives
pertaining to cases: 2024-10395, 2024-10479, 2024-10647, 2024-10659 is
being denied in that it would violate the citizens reasonable expectation
of privacy under N.J.S.A. 47:1A-1a, and pursuant to: N.J.S.A. 47:1a-9(b)
which states: The provisions of this act, P.L.2001, c.404 (C.47:1A-5 et
al.), shall not abrogate or erode any executive or legislative privilege
or grant of confidentiality heretofore established or recognized by the
Constitution of this State, statute, court rule or judicial case law,
which privilege or grant of confidentiality may duly be claimed to
restrict public access to a public record or government record. "The
Prevention of Domestic Violence Act of 1991" states: All records
maintained pursuant to this act shall be confidential and shall not be
made available to any individual or institution except as otherwise
provided by law.
Thank you.
