This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:
The following 3 requests pertain to the calendar years of 2022 and 2023
- List of all cellular telephone numbers owned by the Township of Clark and issued to Township employees, elected and appointed officials to include the cellular telephone number, the name of the employee or official it is assigned to and which township's department said employee or official is assigned to
- List of expenses or reimbursements paid by the Township of Clark to township employees, elected or appointed officials for the usage of their personal owned cellular telephones;
- All policies, rules, regulations, memorandums issued by the Township of Clark and all of its departments (ie: Public works, Police, Administration, etc) regarding the usage of cellular telephone, township of personally owned, during work hours or while in the performance of their duties.

The Township of Clark received your Open Public Records Act (OPRA) request
on February 13, 2023 (5:17 PM). The official Records Custodian, Edith
Merkel, received your OPRA request on February 14, 2023. As such, the
seven (7) business day deadline to respond to your request is February 24,
2023. The response to your request is being provided to you on the 2^nd
business day after the custodian's receipt of said request. Your request
is hereby satisfied.

Jennifer E. Kobliska, CFO, stated that we don't reimburse anyone for
personal cellphone bills/usage.

Excerpt from our Personnel Policy. That is all I have on Employee Cell
Phone Usage.

Township-Issued Mobile Phones/Devices. Township-issued mobile devices may
be issued to certain employees in the course of their employment with the
Township. Such Township-issued devices are the sole and exclusive property
of the Township and are only to be utilized by employees in the course and
scope of their employment during working time (any time in which
the employee is engaged in or required to be performing work tasks
for the Township not to include times when employees are properly not
engaged in performing work tasks, including break periods and mealtimes.)
Employees will be charged for costs incurred due to their personal use of
such devices. Accordingly, the Township reserves the right to monitor the
use of the Township-issued cell-phones without notice, at any time, and
any such data collected from the mobile device equipment is the
sole and exclusive property of the Township to be used for any
purpose.
Similarly, the Township reserves the right to review the manner and use of
these mobile devices and physically inspect the equipment at any time with
or without notice. Accordingly, the employee shall have no reasonable
expectation of privacy in any transmissions made or received
using a Township-issued mobile device.
Employees are expected, at all times, to respect the integrity of the
Township-issued mobile devices and to maintain the equipment in proper
working condition. If an employee discovers or recognizes that the mobile
device is not in proper working condition, it is the employee’s
responsibility to bring this fact to the attention of his or her
supervisor immediately.
Upon termination of employment or in the instance of an upgrade
to the employee’s phone or service, the employee must return the
Township-issued device to the Township.
The records are being provided in their entirety and are responsive to
your request.
The following legal basis applies to responses that include redactions. "
A government record shall not include the following information which is
deemed to be confidential for the purposes of P.L. 1963, c 73 (C.47:1A-1
et seq.) as amended and supplemented: that portion of any document which
discloses the social security number, credit card number, unlisted
telephone number or driver license number of any person..."
If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the Township of Clark to deny access.
At your option, you may either institute a proceeding in the Superior
Court of New Jersey or file a complaint with the Government Records
Council (GRC) by completing the Denial of Access Complaint Form. You may
contact the GRC by toll-free telephone at 866-850-0511, by mail at P.O.
Box 819, Trenton, NJ, 08625, by email at [email address], or at their
website at www.state.nj.us/grc. The GRC can also answer other questions
about the law. All questions regarding complaints filed in Superior Court
should be directed to the Court Clerk in your County.
