Thank you for your response dated May 21, 2025, regarding my OPRA request.

I would like to clarify that my request is directed to the Brick Township Police Department, not the Municipal Court. While the summonses I referenced (E25 2288 and E25 2289) are filed in the Brick Township Municipal Court, my request pertains to records maintained by the Police Department, including:

Copies of the summonses or complaints

Detailed Computer-Aided Dispatch (CAD) logs

Officer narratives related to the incidents

Any associated body-worn camera footage, if available

As established in State v. McLain, 312 N.J. Super. 661 (App. Div. 1998), both the judiciary and law enforcement agencies are considered joint custodians of records related to complaints, summonses, and warrants. Furthermore, the New Jersey Supreme Court in Simmons v. Mercado, 247 N.J. 24 (2021), affirmed that police departments are obligated to respond to OPRA requests for complaint-summonses, even if those records are stored on judiciary servers, because the information is initially entered by police officers.

Given this, I respectfully request that the Brick Township Police Department process my OPRA request for the aforementioned records. If any of these records are maintained by the Municipal Court and require a separate request, please advise accordingly.
