Dear Cherry Hill Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

After careful review of your OPRA request received December 12,
2024, we have determined that your request is for documents that
are considered exempt as noted below:
N.J.S.A. 47:1A-3(a) Specifically No. 24) Ongoing investigations -
any records pertaining to an investigation in progress by any
public agency if disclosure of such record or records shall be
detrimental to the public interest. This provision shall not be
construed to allow any public agency to prohibit access to a
record of that agency that was open for public inspection,
examination, or copying before the investigation commenced.
As a result of our search, subsequent findings and this response
to your request, we have marked your OPRA request received
December 12, 2024 as satisfied and closed.
A copy of the Denial Poster with instructions to applicants who
wish to appeal any denial or part thereof is attached hereto. You
have the right to appeal the decision that the document or
documents are not public records. You may take your appeal to the
Government Records Council or the New Jersey Superior Court, as
provided by N.J.S.A. 47:1A-1 et seq.

Dear Cherry Hill Township,
For clarification, is it the Township's position that there is no method of redaction of the CAD report regarding the call for service that can result in the document being produced? My understanding is this document would simply contain addresses, officers involved with their arrival and departure times, and other binary information and is not an investigative record.
Additionally, it appears that it is the Township's position that the release of such a record is detrimental to the public interest as stated in the denial letter. It is my position that a simple CAD dispatch report regarding a homicide in a residential neighborhood is very much in the interest of the public at large and cannot fathom how one could deem it detrimental.
Please confirm that the Township will not produce the record requested or reply with the responsive records.
In the event of a confirmation of denial, please clearly state who specifically is denying the request (the e-mail indicates both Danielle Gyenge and Patti Chacker) so that I have the correct information for the GRC appeal.

Yes, it is the position of the Township that the entire record pertains to an investigation in progress and the release of such a record is inimical to the public interest. I am confirming that the Township of Cherry Hill is denying that portion of your request on those grounds.
Additionally, the person denying the request is myself, Patti Chacker, in my capacity as Records Custodian for the Township of Cherry Hill.
