Dear Little Silver Borough,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

Hello and Good Morning,

There are twenty-seven (27) BWC videos for this time frame 6a-6p that need to be reviewed. Is there any possible way this can be narrowed down further? We are a small municipality with limited staff, and this will be time consuming and burdensome especially with redactions if any of the footage involves juveniles in the vehicles , addresses, drivers licenses etc.

Dear Tony:

 

The Borough of Little Silver Records Custodian, Kevin Burke received your
request on September 16, 2025.  The Little Silver Police Department
Records Clerk, Katy Inacio, received your OPRA request on September 16,
2025. This response is being provided to you within the seven (7) business
day period to respond.  Your OPRA request sought access to the following:

 

Requested:       

 

Body worn camera footage of all traffic stops performed on 7-4-25.

Request amended to:  Body worn camera footage of all traffic stops

6 AM to 6 PM

 

Response:          

 

Your request requires additional time beyond the seven (7) business days
to fulfill as redactions are necessary to the BWC videos requested.  We
are a small agency with a limited support staff, therefore redactions to
this large amount of videos requires additional time.  OPRA allows
custodians to seek extensions of time pursuant to N.J.S.A. 47:1A-5.1. 
Specifically, OPRA states that, “the requestor shall be advised by the
custodian when the record can be made available.  If the record is not
made available by that time, access shall be deemed denied.”

 

Your request requires an extension of seven (7) business days.  If these
videos are complete prior to the seven (7) business day extension, same
will be forwarded to you at that time.  The new due date for the BWC
videos is October 6, 2025.

 

If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the Borough of Little Silver/Little
Silver Police Department to deny access. At your option, you may either
institute a proceeding in the Superior Court of New Jersey or file a
complaint with the Government Records Council (GRC) by completing the
Denial of Access Complaint Form.  You may contact the GRC by toll-free
telephone at 866-850-0511, by mail at P.O. Box 819, Trenton, NJ, 08625, by

www.state.nj.us/grc. The GRC can also answer other questions about the
