The Borough of Englishtown received your Open Public Records Act (OPRA)
request on August 31, 2021.  As such, the seven (7) business day deadline
to respond to your request is September 9, 2021.  This response to your
request is being provided to you on the 1st business day after the
custodian’s receipt of said request
Your request sought access to the following:
Borough policy regarding nepotism

This record is being transmitted to you via email as per your request. 
Pursuant to N.J.S.A. 47:1A-5.b., there is no cost associated with this
request.

1.14  NEPOTISM POLICY

 

A.   No member of a family shall be in a position that provides
supervision over another member of the same family. This precludes the
acceptance of applications for employment from relatives for positions in
the same department where supervision conflicts exist.

 

Relatives, for the purpose of this policy, are defined as spouse, parent,
child, stepchild, domestic partner, sibling, grandparent, grandchild,
niece, nephew, aunt, uncle, and cousin to the third degree or in-laws by
reason of relation to any of the above. 

 

B.  Borough employees who were hired prior to the election of a relative
shall remain employed, and their promotions, compensation and other terms
of employment shall not be affected.  However, the employee and the
elected official cannot act on one another’s behalf in any way; failure to
follow this policy will be grounds for discipline, censure, and possible
dismissal.

 

C.  This policy is not for the purpose of depriving any citizen of an
equal chance for government employment, but is solely to eliminate the
potential for preferential treatment of the relatives of government
personnel.

 

            This policy will not deprive any present employee of any
promotional right in normal career development, nor change the existing
status of any employee.

If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the Borough of Englishtown to deny
access. At your option, you may either institute a proceeding in the
Superior Court of New Jersey or file a complaint with the Government
Records Council (GRC) by completing the Denial of Access Complaint Form. 
You may contact the GRC by toll-free telephone at 866-850-0511, by mail at
P.O. Box 819, Trenton, NJ, 08625, by e-mail at [email address], or at
their web site at www.state.nj.us/grc. The GRC can also answer other
questions about the law.  All questions regarding complaints filed in
Superior Court should be directed to the Court Clerk in your County.
