Body camera Footage
Dear Delaware Township,
I am requesting body worn camera footage from all traffic stops between 7-1-25 and 7-20-25.
I have not been convicted of any indictable offense
I Will not use these records for any commercial purposes
The maximum authorized cost is $0.

Hello Mr. Michael,
I received your OPRA request, however, I have some feedback:
Per NJSA 47:1A-1 et. seq., requestors are not required to use this OPRA
request form; however, a written equivalent not containing the form
requirements of N.J.S.A. 47: IA-5(f) and N.J.S.A. 47: IA-5(g) may be
denied by a custodian. Therefore, please provide the missing information.
For example, you did not provide a response to all 3 certifications, nor
some of the contact information.
Additionally, there are costs associated with this type of footage. We
need to provide it on a usb or cd (cannot email) and there may be a cost
for redaction as the footage must be reviewed before release. You have
not authorized any cost to cover this. Per 47:1A-5 (2) b. Access to
electronic records and non-printed materials shall be provided free of
charge, but the public agency may charge for the actual costs of any
needed supplies such as computer discs. Additionally, Per C.47:1A-5 (2) c.
"... in addition to the actual cost of duplicating the record, a special
service charge that shall be based upon the actual direct cost of
providing the copy or copies, and such special service charge shall be
reasonable. The custodian shall provide the requestor with an explanation
for and an itemized list of the fees or charges. The requestor shall have
the opportunity to review and object to any fee or charge prior to it
being incurred. There shall be a rebuttable presumption that the fees or
charges presented by the custodian are reasonable. If the requestor
objects to the fees or charges, the burden of proof shall be on the
requestor to demonstrate that the fees or charges are unreasonable."
A special service charge is essentially a labor fee that may be charged
when a request is voluminous, requires extensive time and effort, or when
the request requires extensive use of technology. Special services
charges should be based on actual direct cost of fulfilling the request.
Actual direct cost means the hourly rate of the lowest level employee
capable of fulfilling the request (no fringe benefits). [1]SOURCE:

Hello Mr. Michael,
As I have not received a response to my request for additional information
this request is denied per N.J.S.A. 47: IA-5(f) " If a letter or an email
from a requestor does not include all of the information required on the
adopted form, the custodian may deny the record request."
