The Spring Lake Police Department has received your Open Public
Records Act (OPRA) and common law right of access request. Below is the
response for the video portion of your request.

 

Body Worn Camera Recordings that Raise Special Privacy or Safety Issues

The body worn camera(s) footage you requested contains footage of one or
more of the following that must be redacted: (a) captures the image of a
victim of a criminal offense; (b) captures the image of a child; (c) was
made in a residential premise (e.g., home, apartment, college dormitory
room, hotel/motel room, etc.), a school or youth facility, a healthcare
facility or medical office, a substance abuse or mental health treatment
facility, or a place of worship; (d) captures a conversation with a person
whose request to de-activate the BWC was declined; (e) captures a special
operations event or execution or an arrest and/or search warrant where
confidential tactical information may have been recorded; (f) captures the
image of an undercover officer or confidential informant; (g) captures the
screen of a police computer monitor that is displaying confidential
personal or law enforcement sensitive information; or (h) any other
confidential personal or medical information.

 

In accordance with N.J.S.A. 47:1A-5c the Spring Lake Police Department
reserves the right to charge a Special Service Charge for the following:
“Whenever the nature, manner of collation of volume of government record
embodied in the form of printed matter to be inspected, examined or copied
pursuant to this section is such that the record cannot be reproduced by
ordinary document copying equipment in the ordinary business size or
involves an extraordinary expenditure of time and effort to accommodate
the request, the public agency may charge, in addition to the actual cost
of duplicating the record, a special service charge that shall be
reasonable and based upon the actual direct cost of providing the copy or
copies….”

 

Your request:

BWC videos for case _25-6804__

We have reviewed your request and _2_ police officers were present on
scene with a total of __2__ videos consisting of __28___ minutes of video.
From our experience it takes approximately 5 minutes for each 1 minute of
video to review and redact the video. The current lowest hourly rate for
the Department’s Dash / Body Worn Camera Unit staff capable of fulfilling
the request is $1.55 per minute. We estimate that the redaction will
require at least __140____ minutes to prepare, thus an estimated cost of $
_217.00_. If you agree to the fee you are required to remit 100% of the
payment to the Spring Lake Police Records Department before the police
department will commence processing your request. Since this is an
estimate your balance due may be less if the project is completed faster,
but it may be higher if it takes longer to prepare. Please provide written
confirmation of your acceptance or rejection of the Special Service Charge
and date of anticipated payment. The Police Department will assume that
you do not want to continue with the video portion of your request if the
Police Department does not receive your deposit in five business days and
will consider this portion to be closed.

Dear Spring Lake Borough,

Please accept this electronic request for public records made under OPRA
and the common law right of access.  I am not required to fill out an
official form or use a particular software platform to submit my request
per NJSA 47:1A-6(f), which states that an email from a requestor including
all of the information required on the adopted form shall suffice in place
of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New
Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

Copy of police report and body camera footage from all responding officers
to a bicycle accident that I was an involved party in on August 11th 2025
at approximately 4:05 PM. This incident took place at 1st and Newark
Avenue.

as attachments.  Please confirm you have received this request.  If you
