Dear New Jersey State Police,

request for body worn camera footage was denied.

The body worn camera footage responsive to your request does not capture a
criminal offense, but a traffic infraction and does not fall within the
provisions of N.J.SA. 40A:14-118.5(j)(3)(a) as pertaining to a criminal
investigation or subject to discovery in a prosecution.  The footage is
subject to N.J.S.A. 40A:14-118.5(l)(1)-(3), which provides that body worn
camera not subject to a minimum three-year retention period or other
additional retention requirements are exempt from public inspection. See
also Geronimo v. N.J. State Police, GRC. 2023-264 (June 24, 2025). 
Furthermore, you have not identified yourself or provided evidence
indicating that you are an acceptable party to review the footage under
N.J.S.A. 40A:14-118.5.  Therefore, the body worn camera footage is exempt
from public access and the Division of State Police stands by its denial
of your OPRA request.
