Dear L. Smith,
The County of Middlesex received your Open Public Records Act (OPRA)
request on June 13, 2022 seeking “Overtime compensation/ exact dollar
amounts for Board of Elections members (by first and last names) for the
following years, including dates worked:
2020, 2021, 2022.”
Currently, your request fails to identify with reasonable clarity the
specific government records sought, as is required by Bent v. Stafford
Police Department, 381 N.J. Super. 30, 37 (App. Div. 2005) insofar as the
title “Board of Elections members” does not exist. Stated otherwise, we
are seeking clarification as to whether you are seeking the overtime hours
for employees of the Board of Elections or with regard to the Board of
Elections Commissioners (referred to at times as the members of the Board
of Elections).
At this time, we request clarification of your OPRA request. Please
respond in writing and identify the specific government records sought so
that we may process your request.

Dear L.Smith:
The County of Middlesex received your Open Public Records Act (OPRA)
request on June 13, 2022 seeking “Overtime compensation/ exact dollar
amounts for Board of Elections members (by first and last names) for the
following years, including dates worked:
2020, 2021, 2022.” You have now clarified that the request pertains to
Board of Election employees.
With that clarification, attached please find the dollar amounts paid to
Board of Elections employees for 2020-2022 for overtime. As per your
request for employee time cards, this request is voluminous and will
require additional time beyond the seven (7) business days to fulfill
because it will require the compilation of voluminous records and the
removal of private employee information. OPRA allows custodians to seek
extensions of time pursuant to N.J.S.A. 47:1A-5.i. Specifically, OPRA
states that, “the requestor shall be advised by the custodian when the
record can be made available. If the record is not made available by that
time, access shall be deemed denied.”
Your request requires an extension of time until July 6th .
