Jersey Legislature is providing for exception to the deadlines otherwise
required for OPRA responses.

The bill states:  During a period declared pursuant to the laws of this
State as a state of emergency, public health emergency, or state of local
31 disaster emergency, the deadlines by which to respond to a request
 for, or grant or deny access to, a government record under paragraph (1)
of this subsection or subsection e. of this section shall  not apply,
provided, however, that the custodian of a government record shall make a
reasonable effort, as the circumstances permit, to respond to a request
for access to a government record within  seven business days or as soon
as possible thereafter.

Since town hall employees are currently  working remotely, we may require
an extension to fulfill your request if we cannot meet the usual 7
business day deadline.

We will make every effort possible to respond as quickly as possible.

Good afternoon,

The Police Department has been working on a response to your request but they need clarification on what you are looking for. Some information that would help get closer to finding the documents you are looking for is:
- Who was the email sent to?
- What is the complaint regarding?
- Who made the complaint?
- What department was the complaint against?

Because of this, the Police Department requires an additional extension of 7 business days to fulfill request. The new due date is on or before May 12, 2020.

The Township of Bloomfield received your Open Public Records Act (OPRA)
Request on April 13, 2020.  Due to the current situation with COVID-19,
the township was granted an extension to respond to your request to on or
before May 12, 2020. The response is being sent today – May 4, 2020.

Your OPRA request sought access to the following:

“  Records requested:
Email sent from Bloomfield police department
[1][email address]
April 8th 2020  including the attached document
RE: Fwd: Complaint against the Bloomfield police Department.”

The following records are being provided in their entirety and are the
ONLY documents in the Township’s possession responsive to your request:

1.       From the Township’s Police Department – “the email received was
not sent by the Bloomfield Police Department.  The Bloomfield Police
Facebook page may have been compromised or utilized in some type of
phishing scheme by unknown individuals… we have received thus far one
other notification from a company based in North Carolina that notified
our Department that they received an email from the same email address as
the requestor did, which did contain an attachment that was malware.  They
notified our Department to make us aware of the situation.

We are in the process of notifying Facebook, however our Police Department
was not notified by Facebook of any type of breach in the security of the
site.  We are unsure at this time if the Facebook page was breached or if
the email was a phishing attempt with a spoofed email address.  A spoofed
email address is more likely. Either way we obviously cannot give a copy
of an email that we never created nor do we have any way of knowing what
the attachment to the email actually was. However if it was the same type
of email that the company in North Carolina received, their computer
security protocols blocked the email attachment due to it containing a
malware program. ”
