Thank you and have a great day!
Montville Township received your request for public records pursuant to
the Open Public Records Act (OPRA) and the common law right of access.
Your request was received on 6/6/2024. The statutory deadline for response
is 6/17/2024. This communication is being sent to you on the 1^st business
day after receipt.
Your request seeks, “final and compiled bid tabulation (Bid Tally),
including all quantities and unit pricing for each bidder, for Vista Road
Storm Sewer Replacement that was submitted on 6/5/2024.”
Pursuant to N.J.S.A. 47:1A-1.1, your request is denied due to “information
which, if disclosed, would give an advantage to competitors or bidders.”
The lowest responsible bid is still under administrative and attorney
review which could potentially result in a disqualification of the bidder
or rejection of all bids. Once a contract is awarded or all bids rejected
by resolution of the Township Committee, the bid tabulation is releasable.
You can resubmit your request at that time.
Please contact either me or Township Clerk Stacy Kostka if you have any
questions.
If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the denial of access. At your option, you may either
institute a proceeding in the Superior Court of New Jersey or file a
complaint with the Government Records Council (GRC) by completing the
Denial of Access Complaint Form. You may contact the GRC by toll-free
telephone at 866-850-0511, by mail at P.O. Box 819, Trenton, NJ, 08625, by
e-mail at [1][email address], or at their web site at
[2]www.state.nj.us/grc. The GRC can also answer other questions about the
law. All questions regarding complaints filed in Superior Court should be
directed to the Court Clerk in your County.
Thank you,
