Good Morning,
Montville Township received your OPRA request seeking the bid tabulation
results for the above-captioned project. I thought we previously
responded, but I am unable to locate that reply. I am responding again in
order to close it out. Please accept our apologies for this delay.
Bid results are under administrative and attorney review and have not yet
been awarded. Pursuant to NJSA 47:1A-1.1 (information which, if disclosed,
would give an advantage to competitors or bidders), your request is denied
since the Township does not yet know whether the apparent lowest
responsive bid will be found to be non-compliant or whether all bids will
be rejected at this time.
The Township has not set a date to award the contract, so I am unable to
give you a date certain that you can resubmit your request. Please check
back with us in July.
If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the denial of access. At your option, you may either
institute a proceeding in the Superior Court of New Jersey or file a
complaint with the Government Records Council (GRC) by completing the
Denial of Access Complaint Form. You may contact the GRC by toll-free
telephone at 866-850-0511, by mail at P.O. Box 819, Trenton, NJ, 08625, by
