On June 19, 2023, the Township of Wall (“Township”) received your Open Public Records Act (“OPRA”) request. The Township is responding to your request within seven (7) business days after receipt of your request as required by New Jersey law. See N.J.S.A. 47:1A-5.
For ease of reference, your OPRA request seeks the following:
1. [T]o request an internal review of Wall Township's handling of my OPRA request 'Bid Tabulation Results for Basketball & Tennis Courts Project at Orchard Park & Heroes Park'.
With respect to your request seeking “internal review,” as a threshold matter, is invalid because it fails to identify a government record. See Murphy v. N.J. Dept. of Corrections, GRC Complaint No. 2015-340. OPRA provides that government records made, maintained, kept on file, or received by a public agency in the course of its official business are subject to public access unless otherwise exempt. N.J.S.A. 47:1A-1.1. A custodian must release all records responsive to an OPRA request “with certain exceptions.” N.J.S.A. 47:1A-1. OPRA defines a “government record” as: any paper, written or printed book, document, drawing, map, plan, photograph, microfilm, data processed or image processed document, information stored or maintained electronically or by sound-recording or in a similar device, or any copy thereof, that has been made, maintained or kept on file…or that has been received in the course of his or its official business.

Since the requested “internal review” is not a government record and invalid under OPRA, the Township must deny your OPRA request. In the event of a clarification or appeal, Township reserves the right to raise any other ground for denial not raised in this response. The failure of Township to assert an exception or privilege at this time does not act as a waiver of any grounds for denial. Thank you for your professional courtesies and attention to this matter.
