This Office has reviewed your OPRA request for a “. . . bid tabulation
(Bid Tally), including all quantities and unit pricing for each bidder,
for Install Fitness Circuit Equip & Safety Surfacing. . .” As referenced
previously, no such responsive records exist, and would need to be
created.
Under OPRA, custodians are not required to conduct research or create new
records in response to an OPRA request. See generally Paff v. Galloway
Twp., 229 N.J. 340, 353 (2017).
You have already been provided with a copy of the resolution and were
emailed information listing the bids received and the results of the bid.
Insofar as you have requested this information in pdf format, please see
attachment containing the resolution that was previously sent to you.
