Dear Rowan University,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

Base bid amount for Tester and Gaudelli for RFP 26-38 since it was not read publicly per NJ law.

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Yours faithfully,

Jay MIxner

Hello,

Please accept this as Rowan University’s completed response to your OPRA request (below) wherein you sought the Base bid amount from Tester and Gaudelli for RFP 26-38.

In response, Rowan University providing the attached Pricing Sheets from Tester and Gaudelli for RFP 26-38. Please be advised that they contain the following redactions:
1. Signatures (N.J.S.A. 47:1A-1 and Burnett v. Cnty. of Bergen, 198 N.J. 408 (2009))

You have the right to challenge the redaction made by Rowan University. You can file a Complaint in the Superior Court of New Jersey or complete a Denial of Access Complaint Form with the Government Records Council (GRC). You can contact the GRC at 866-850-0511; or by mail at P.O. Box 819, Trenton, NJ 08625; or via email at [email address]; or through its website athttp://www.state.nj.us/grc.

Although not a request for documents, as counsel in Rowan University's General Counsel's office, I reached out to the Procurement department with regards to your comment that the base bid amount "was not read publicly per NJ law." This is an RFP and not an IFB. As such, since the award is based on price and other factors, Rowan does not publicly read the base bid amounts at the time of opening.

As you may know, OPRA requires a response within seven business days, in this case that is today June 3, 2026. This is a full response to your OPRA request and Rowan will close this request unless you advise otherwise.

If you have any questions and/or would like to discuss this matter further, please do not hesitate to reach out to me at any time.
