Good afternoon,
The Office of the State Comptroller (OSC) received your OPRA request on
August 30, 2024.  The seven business-day deadline to respond to your
request is September 11, 2024. Your request requires additional time to
fulfill.  OPRA allows custodians to seek extensions of time pursuant to
N.J.S.A. 47:1A-5.i.  Your request requires an extension of time of an
additional 5 business days.  As such, you will receive this office’s
response to your request on or before September 18, 2024.

Good afternoon,

 

The Office of the State Comptroller (OSC) received your OPRA request on
August 30, 2024.  The seven business-day deadline to respond to your
request is September 11, 2024. On September 10, 2024, OSC sought an
additional 5 business days (September 18) to respond to your request
pursuant to N.J.S.A. 47:1A-5.i.  This request is being provided to you on
September 16, 2024.

 

Your request sought access to the following: “Any surveys from 2016 to
2021 for all beach revenue and expenses that was conducted by the
Comptroller's office for all jersey shore municipalities.”

 

Please be advised that your request is denied.  Pursuant to N.J.S.A.
52:15C-11, OSC reports the findings and recommendations of audits and
reviews to the Governor, the President of the Senate, and the Speaker of
the General Assembly.  Final reports are issued publicly and posted on
OSC’s website.  OSC has not issued any final reports concerning the
subject matter of your request.  Thus, to the extent any surveys exist
concerning the subject matter of your request, they would be considered
advisory, consultative or deliberative and protected from public
disclosure.

 

Your request also seeks access to records under the common law right of
access. That request is denied because OSC’s interests in protecting
documents considered confidential and deliberative in nature, to the
extent any such documents exist, outweighs your interest in accessing such
records.

 

In light of the above, OSC considers its response to this request to be
completed. OSC reserves the right to supplement its bases for denial with
any additional basis for exemption to public access as may hereinafter
also be determined to apply.
