Ballot Design Case Expenses
Dear Hunterdon County,
This is a request for public records made under OPRA and the common law right of access.
The records requested relate to two federal lawsuits concerning the design of New Jersey’s primary ballots: Conforti v. Hanlon, 3:20-cv-08267 (USDNJ) and Kim v. Hanlon, 3:24-cv-01098 (USDNJ) including its Third Circuit appeal (3d Cir, 24-1594).
Records requested:
1. Documents constituting or evidencing a list of all payments to outside counsel, legal consultants, and other expenses associated with these lawsuits since July 1, 2020. (Note: I am seeking payments related to the legal challenges described above. If you cannot sort in that manner, then I will take a list of all payments. This probably exists in a vendor history/activity report.)
2. Invoices for outside counsel, legal consultants, and other expenses associated with the lawsuits described above since July 1, 2020. (Note: Again, I am only seeking payments related to the legal challenges described above. If you can sort in that manner, then that is all that is needed. Otherwise, I request all invoices.)
Please produce the list of payments immediately. I understand the invoices may take longer, although they are also "immediate access" documents.

Hunterdon County is in receipt of your Open Public Records
Act (OPRA) request dated 08/16/2024. As such, the seven
(7) business day deadline to respond to your request
is 08/27/2024. This response to your request is being
provided to you on 08/20/2024.
Your OPRA request sought access to the following:

understand the invoices may take longer, although they are

Please note that your request is not in its entirety a
valid OPRA request because it asks questions or seeks
information and fails to identify with reasonable clarity
all the specific government records sought. A party cannot
satisfy this requirement by simply requesting all of an
agency's documents. See Bent v. Stafford Police
Department, 381 N.J. Super. 30, 37 (App. Div. 2005). A
custodian is not required to conduct research or create
new records in response to an OPRA request.
The County has responded by providing records which may be
responsive to your request. You can access those documents
by clicking the "documents" tab in your request.
Your Open Public Records request has been processed in
accordance with N.J.S.A. 47:1A-1, et seq. If your request
has been denied in whole or in part, the County of
Hunterdon reserves the right to raise any other grounds
for denial not raised in this response. The failure of the
County of Hunterdon to assert an exception or privilege
herein does not act as a waiver of any ground for denial
not raised herein.
The County considers your OPRA request closed.
