RE: OPRA REQUEST of 5/5/2023, Reference # W025467-050523

Dear Requester,

The Camden County Custodian of Records received your Open Public Records
Act request on 5/5/2023.  To access your request and retrieve your records
please click [2]here.

The Camden County Departments conducted a search of their records and
provided the following responses to each portion of your request.
Your request: "1. The badge camera footage of Arthur Barclay being
arrested for assaulting his then fiance from Camden Metro Police."

Custodian's response: The Camden County Police Department provided records
responsive to this portion of your request. The records provided contain
redactions pursuant to N.J.S.A. 47:1A-1.1, et seq. - Drivers’ license
numbers, N.J.S.A. 47:1A-1.1, et seq. - N.J.S.A. 2A:82-46b - Victim’s name
or address, and
N.J.S.A. 47:1A-1.1; N.J.S.A. 47:1A-6; Feggans v. City of Newark (Essex),
GRC Complaint No. 2007-238 (October 2008); Morgano v. Essex County
Prosecutor’s Office, GRC Complaint no. 2007-156 (February 2008); Nance v.
Scotch Plains Township Police Department, GRC Complaint No. 2003-125
(January 2005); Patricia Elaine Cheatham v. Borough of Fanwood Police
Department (Union), GRC Complaint No. 2013-262 (March 2014) - Criminal
investigatory records, as is required by N.J.S.A. 47:1A-6.

Your request: "2. The 911 call audio that prompted Camden Metro to report
to this event."

Custodian's response: The Camden County Department of Public Safety
informed our office that no records exist for this portion of your request
due to the 90-day retention schedule for audio files. However, if audio
did exist, the Department is unable to search for incidents by parties
involved and therefore your request is too broad or contains insufficient
information and seeks documents that are not specifically “identifiable”
for the Department to gather a response. As such, this portion of the
request submitted is a wholesale request for information that is not
encompassed by the intent of OPRA as has been articulated in N.J.S.A.
47:1A-1, et. seq. and MAG Entertainment v. Division of Alcoholic Beverage
Control, 375 N.J. Super. 534 (App. Div. 2005).

All future requests related to 911 audio and/or Computer Aided Dispatch
(CAD) reports must include the following information:

- Type of incident, date, exact time, location and name of individual(s)
- For cell phone calls, provide the cell phone number(s) and name of
caller(s) (if known)

As such, this correspondence and the records provided constitutes
completion of your request.

Pursuant to N.J.S.A. 47:1A-1, et seq. if your request for access to a
government record has been denied or unfilled within the seven (7)
business days required by law, you have a right to challenge the decision
by the County of Camden to deny access.  As provided by law, you have the
right to either institute a proceeding in the Superior Court of New Jersey
or file a complaint with the Government Records Council (GRC) by
completing their Denial of Access Complaint Form located at the GRC’s
website at [3]www.state.nj.us/grc.

You may contact the GRC by toll-free telephone at 866-850-0511, by mail at
P.O. Box 819, Trenton, NJ, 08625, by e-mail at [4][email address]. The
GRC can also answer other questions about the law. All questions regarding
complaints filed in Superior Court should be directed to the Superior
Court.
