Dear Requestor,

The Borough of Seaside Heights is in receipt of your OPRA request dated May 18, 2023 for the following:
1. I'm requesting copies of all attorney invoices for Seaside Heights from January 1, 2021 to May 08, 2023 .
2. I'm requesting copies of all settlement agreements from January 1, 2021 through May 08, 2023.

Please be advised that, due to the number hours of estimated to retrieve, scan, re-staple and return to storage the requested attorney invoices, together with time for review and redaction of the invoices, production of the documents in this request will require an estimated 30 hours to complete,. The retrieval, scanning, re-stapling and return to storage will require approximately 21 hours to complete at a rate of pay of $20.40 per hour, for a total of $428.40 which is the base rate of pay without fringe benefits of the lowest paid employee qualified to retrieve the records. The review and redaction is estimated at a total of 9 hours, at the rate of $34.40 per hour which is $309.60. The total estimated special service charge is $738.00.

OPRA allows public agencies to impose special service charges whenever the nature, format, manner of collation, or volume of a government record embodied in the form of printed matter to be inspected, examined, or copied pursuant to this section is such that the record cannot be reproduced by ordinary document copying equipment in ordinary business size or when fulfilling a request requires an extraordinary expenditure of time and effort. See N.J.S.A. 47:1A-5.c. Special service charges must be based upon the actual direct cost of providing the copy or copies.

OPRA mandates that the requestor shall have the opportunity to review and object to the charge prior to it being incurred. See N.J.S.A. 47:1A-5.c. As such, a detailed estimate is provided below:

The total estimated special service charge is $738.00

Kindly respond in writing with your acceptance or rejection of this estimated charge. We will not begin to process this request until we receive your written acceptance.
