You have submitted an Open Public Records Act (OPRA) request and indicated

Your request seeks:
1. All communications from 2010, between Atlantic County Counsel
James Ferguson, Assistant County Counsel James Dugan, Director Robert
Howie, and Senator Jim Whelans, discussing the creation of bills,
legislation, or revised legislation, which would repeal or affect NJSA
51:1-46.
2. The Terri Hiles sexual harassment settlement. The Shelly
Imperatore sexual harassment settlement.
3. The Atlantic County Weights and Measures Certificate of
Conformance for 2013 – 2017.
4. As per NJSA Title 51:1-71; County Weights and Measures
Superintendents must submit an annual report to the New Jersey Office of
Weights and Measures. Please provide the annual Atlantic County reports
for 2013-2016.
5. The details, including balance, of the Atlantic County Weights
and Measures Fund.

The IT department is still working on request #1, as Robert Howie is no
longer employed by Atlantic County.

Dear Atlantic County,
Please pass this on to the person who conducts Open Public Records Act reviews.
I am writing to request an internal review of Atlantic County's handling of my OPRA request 'Weights and Measures Certificate of Conformance'.
Thank you for your attention and the information that you sent, however, as I already mentioned, what you sent is not what I requested. The annual reports must have been done in writing and be signed and sworn to. That is not what you sent. Here's the Statute for your reference.
51:1-71. Superintendents; annual reports
Every municipal and county superintendent shall also make an annual report in writing, duly subscribed and sworn to by him of his work to the state superintendent. Said report shall be forwarded to the state superintendent within ten days after the last day of the state fiscal year. It shall contain a transcript of the reports of all inspections.
As for the Certificates of Conformance, you've sent me State of New Jersey Documents, but I specifically requested Atlantic County Documents. State documents are filled out by State employees, and county documents are filled out by County employees. Atlantic County's Weights and Measures Officer had to fill these out by hand. I requested these things on October 30, 2017 and have clarified it twice since.
These documents are stored in the Law Department and easily accessible any day, by any employee, so a month seems excessive.
This request is not complete or successful, because the wrong information is continually being sent.

Mr. Vuocolo:
The annual reports provided to me by the Weights and Measures Department
have been supplied to you. There are no other documents responsive to
that portion of your request.
Regarding the “Certificate of Conformance” – those documents were
previously provided to you, and state on the top of the document
“Certificate of Conformance.” It is completed by a county employee.
The portion of your clarification which states “County documents filled
out by county employees. Atlantic county’s Weights and Measures Officer
had to fill these out by hand” – please specify whether you are referring
to the “Certificate of Inspection & Test” which is another document
completed by a county employee.
If so, I must advise you that the request would be voluminous and a fee
would apply under N.J.S.A. 471A-5.b. If this is the document you seek, I
will calculate the cost.
