The Department of Community Affairs is in receipt of your request, dated
November 10, 2020 and submitted to the Division of Local Government
Services. Your request has also been transmitted by the Division to the
Office of the Commissioner. Your request seeks “any emails sent by
Assistant Commissioner/Chief of Staff Kimberly K. Holmes to potential
candidates …. and any email responses sent back to her from potential
candidates” regarding certain identified positions in Atlantic City.
Your request has been assigned number C166203.
Your request is denied because it seeks access to personnel records,
including communications during the hiring process. Personnel records are
exempt from public access under OPRA, N.J.S.A. 47:1A-10. OPRA’s personnel
records exemption begins as a presumption of non-disclosure and proceeds
with a few narrow exceptions. Kovalcik v Somerset Cty. Pros. Office, 206
N.J. 581, 592 (2011); see also McGee v Tp. Of E. Amwell, 416 N.J. Super.
602 (App. Div. 2010). McGreevey Executive Order No. 26-3 further exempts
personnel records concerning applicants from public access, but it does
allow for access to resumes of successful candidates. Should you seek to
obtain resumes of any successful candidates, you may file a new request
with our office or the City of Atlantic City.
